Common law
–
Common law is the body of law developed from the thirteenth century to the present day, as case law or precedent, by judges, courts, and tribunals. In cases where the parties disagree on what the law is, if a similar dispute has been resolved in the past, the court is usually bound to follow the reasoning used in the prior decision. Resolution of the issue in one case becomes precedent that binds future courts, stare decisis, the principle that cases should be decided according to consistent principled rules so that similar facts will yield similar results, lies at the heart of all common law systems. A common law system is a system that gives great precedential weight to common law. Common law systems originated during the Middle Ages in England, today, one third of the worlds population live in common law jurisdictions or in systems mixed with civil law. The term common law has many connotations, the first three set out here are the most-common usages within the legal community. Other connotations from past centuries are seen, and are sometimes heard in everyday speech. Blacks Law Dictionary, 10th Ed. gives as definition 1,1, the body of law derived from judicial decisions, rather than from statutes or constitutions, CASELAW, STATUTORY LAW. In this connotation, common law distinguishes the authority that promulgated a law. e, examples include most criminal law and procedural law before the 20th century, and even today, most contract law and the law of torts. Interstitial common law decisions that analyze, interpret and determine the fine boundaries. Publication of decisions, and indexing, is essential to the development of common law, while all decisions in common law jurisdictions are precedent, some become leading cases or landmark decisions that are cited especially often. Blacks 10th Ed. definition 2, differentiates common law jurisdictions, by contrast, in civil law jurisdictions, courts lack authority to act if there is no statute. Judicial precedent is given less weight, which means that a judge deciding a given case has more freedom to interpret the text of a statute independently. For example, the Napoleonic code expressly forbade French judges to pronounce general principles of law. As a rule of thumb, common law systems trace their history to England, blacks 10th Ed. definition 4, differentiates common law from equity. This split propagated to many of the colonies, including the United States, for most purposes, most jurisdictions, including the U. S. federal system and most states, have merged the two courts. Additionally, even before the courts were merged, most courts were permitted to apply both law and equity, though under potentially different procedural law. In the United States, determining whether the Seventh Amendments right to a jury trial applies or whether the issue will be decided by a judge, the standard of review and degree of deference given by an appellate tribunal to the decision of the lower tribunal under review

Civil law (legal system)

Conceptually, civil law proceeds from abstractions, formulates general principles, and distinguishes substantive rules from procedural rules. It holds case law to be secondary and subordinate to statutory law, when discussing civil law, one should keep in mind the conceptual difference between a statute and a codal article. The marked feature of civilian systems is that they use codes with brief text that tend to avoid factually specific scenarios, Code articles deal in generalities and thus stand at odds with statutory schemes which are often very long and very detailed. The purpose of codification is to all citizens with manners and written collection of the laws which apply to them. Law codes are simply laws enacted by a legislature, even if they are in much longer than other laws. Other major legal systems in the world include common law, Halakha, canon law, the Scandinavian systems are of a hybrid character since their background law is a mix of civil law and Scandinavian customary law and have been partially codified. Likewise, the laws of the Channel Islands are hybrids which mix Norman customary law, a prominent example of a civil-law code would be the Napoleonic Code, named after French emperor Napoleon. The Code comprises three components, the law of persons, property law, and commercial law, rather than a compendium of statutes or catalog of caselaw, the Code sets out general principles as rules of law. Unlike common law systems, civil law jurisdictions deal with case law apart from any precedent value, Civil law courts generally decide cases using codal provisions on a case-by-case basis, without reference to other judicial decisions. In actual practice, a degree of precedent is creeping into civil law jurisprudence. A line of similar case decisions, while not precedent per se, while civil law jurisdictions place little reliance on court decisions, they tend to generate a phenomenal number of reported legal opinions. However, this tends to be uncontrolled, since there is no requirement that any case be reported or published in a law report, except for the councils of state. Except for the highest courts, all publication of legal opinions are unofficial or commercial, Civil law is sometimes referred to as neo-Roman law, Romano-Germanic law or Continental law. The civil law takes as its major inspiration classical Roman law, and in particular Justinian law, the Justinian Codes doctrines provided a sophisticated model for contracts, rules of procedure, family law, wills, and a strong monarchical constitutional system. Roman law was received differently in different countries, in some it went into force wholesale by legislative act, i. e. it became positive law, whereas in others it was diffused into society by increasingly influential legal experts and scholars. Roman law continued without interruption in the Byzantine Empire until its fall in the 15th century. However, subject as it was to multiple incursions and occupations by Western European powers in the medieval period. It was first received into the Holy Roman Empire partly because it was considered imperial law and it became the basis of Scots law, though partly rivaled by received feudal Norman law

General public

In public relations and communication science, publics are groups of individual people, and the public is the totality of such groupings. This is a different concept to the concept of the Öffentlichkeit or public sphere. The concept of a public has also defined in political science, psychology, marketing. In public relations and communication science, it is one of the more ambiguous concepts in the field, the name public originates with the Latin publicus, from populus, and in general denotes some mass population in association with some matter of common interest. So in political science and history, a public is a population of individuals in association with civic affairs, in social psychology, marketing, and public relations, a public has a more situational definition. John Dewey defined a public as a group of people who, in facing a problem, recognize it. Deweys definition of a public is thus situational, people organized about a situation, built upon this situational definition of a public is the situational theory of publics by James E. Grunig, which talks of nonpublics, latent publics, aware publics, and active publics. In public relations and communication theory, a public is distinct from a stakeholder or a market, a public is a subset of the set of stakeholders for an organization, that comprises those people concerned with a specific issue. Publics are targeted by public relations efforts, the public is often targeted especially in regard to political agendas as their vote is necessary in order to further the progression of the cause. As seen in Massachusetts between 2003 and 2004, it was necessary to win a critical mass of states and a mass of public support in order to get same-sex marriage passed in the commonwealth. Public schools are often under controversy for their agenda-building, especially in debates over whether to teach a religious or secular curriculum, the promotion of an agenda is commonplace whenever one is in a public environment, but schools have exceptional power in that regard. In the public system, it is the responsibility of those within the system to determine what agenda is being promoted. This includes treatment of an individual or group, based on their actual or perceived membership in a certain group or social category, in a way that is worse than the way people are usually treated. Discriminatory traditions, policies, ideas, practices, and laws exist in countries and institutions in every part of the world. In some places, controversial attempts such as quotas have been used to benefit those believed to be current or past victims of discrimination—but have sometimes been called reverse discrimination, the term discriminate appeared in the early 17th century in the English language. Parties to the Convention are required to promote, protect, and ensure the full enjoyment of human rights by persons with disabilities, the text was adopted by the United Nations General Assembly on 13 December 2006, and opened for signature on 30 March 2007. Following ratification by the 20th party, it came into force on 3 May 2008, ageism or age discrimination is discrimination and stereotyping based on the grounds of someones age. It is a set of beliefs, norms, and values used to justify discrimination or subordination based on a persons age. An airline is a company that provides air transport services for traveling passengers and freight. Airlines utilize aircraft to supply services and may form partnerships or alliances with other airlines for codeshare agreements. Generally, airline companies are recognized with an air operating certificate or license issued by a governmental aviation body, Airlines vary in size, from small domestic airlines to full-service international airlines. Airline services can be categorized as being intercontinental, domestic, regional, or international, the largest airline currently is American Airlines Group. DELAG, Deutsche Luftschiffahrts-Aktiengesellschaft was the worlds first airline and it was founded on November 16,1909 with government assistance, and operated airships manufactured by The Zeppelin Corporation. The first fixed wing scheduled air service was started on January 1,1914 from St. Petersburg, Florida to Tampa, the four oldest non-dirigible airlines that still exist are Netherlands KLM, Colombias Avianca, Australias Qantas, and the Czech Republics Czech Airlines. The earliest fixed wing airline in Europe was the Aircraft Transport and Travel, using a fleet of former military Airco DH. 4A biplanes that had been modified to carry two passengers in the fuselage, it operated relief flights between Folkestone and Ghent. On 15 July 1919, the company flew a proving flight across the English Channel, flown by Lt. H Shaw in an Airco DH.9 between RAF Hendon and Paris - Le Bourget Airport, the flight took 2 hours and 30 minutes at £21 per passenger. On 25 August 1919, the company used DH. 16s to pioneer a regular service from Hounslow Heath Aerodrome to Le Bourget, the airline soon gained a reputation for reliability, despite problems with bad weather and began to attract European competition. In November 1919, it won the first British civil airmail contract, six Royal Air Force Airco DH. 9A aircraft were lent to the company, to operate the airmail service between Hawkinge and Cologne. In 1920, they were returned to the Royal Air Force, the first French airline was Société des lignes Latécoère, later known as Aéropostale, which started its first service in late 1918 to Spain. The first German airline to use heavier than air aircraft was Deutsche Luft-Reederei established in 1917 which started operating in February 1919, in its first year, the D. L. R. Operated regularly scheduled flights on routes with a length of nearly 1000 miles. Network was more than 3000 km long, and included destinations in the Netherlands, Scandinavia, another important German airline was Junkers Luftverkehr, which began operations in 1921. Rail transport is a means of conveyance of passengers and goods on wheeled vehicles running on rails, also known as tracks. It is also referred to as train transport. In contrast to road transport, where vehicles run on a flat surface. Tracks usually consist of rails, installed on ties and ballast, on which the rolling stock, usually fitted with metal wheels. A bus is a road vehicle designed to carry many passengers. Buses can have a capacity as high as 300 passengers, many types of buses, such as city transit buses and inter-city coaches, charge a fare. Other types, such as elementary or secondary school buses or shuttle buses within a post-secondary education campus do not charge a fare, in many jurisdictions, bus drivers require a special licence above and beyond a regular drivers licence. Horse-drawn buses were used from the 1820s, followed by steam buses in the 1830s, the first internal combustion engine buses, or motor buses, were used in 1895. Recently, interest has been growing in hybrid electric buses, fuel cell buses, as of the 2010s, bus manufacturing is increasingly globalised, with the same designs appearing around the world. A taxicab, also known as a taxi or a cab, is a type of vehicle for hire with a driver, used by a single passenger or small group of passengers, often for a non-shared ride. A taxicab conveys passengers between locations of their choice, Taxicab is a compound word formed from contractions of taximeter and cabriolet. Taximeter is an adaptation of the German word taxameter, which was itself a variant of the earlier German word, taxe is a German word meaning tax, charge, or scale of charges. The Medieval Latin word, taxa, also means tax or charge, meter is from the Greek metron meaning measure. A cabriolet is a type of carriage, from the French word cabrioler, from Italian capriolare. Both instituted fast and reliable postal services across Europe, the taxicabs of Paris were equipped with the first meters beginning on March 9,1898. They were originally called taxamètres, then renamed taximètres on October 17,1904, horse-drawn for-hire hackney carriage services began operating in both Paris and London in the early 17th century. The first documented public hackney coach service for hire was in London in 1605, in 1625 carriages were made available for hire from innkeepers in London and the first taxi rank appeared on the Strand outside the Maypole Inn in 1636. In 1635 the Hackney Carriage Act was passed by Parliament to legalise horse-drawn carriages for hire, coaches were hired out by innkeepers to merchants and visitors. A further Ordinance for the Regulation of Hackney-Coachmen in London and the places adjacent was approved by Parliament in 1654, a similar service was started by Nicolas Sauvage in Paris in 1637. His vehicles were known as fiacres, as the vehicle depot apparently was opposite a shrine to Saint Fiacre. The hansom cab was designed and patented in 1834 by Joseph Hansom, Hansoms original design was modified by John Chapman and several others to improve its practicability, but retained Hansoms name. These soon replaced the hackney carriage as a vehicle for hire and they quickly spread to other cities in the United Kingdom, as well as continental European cities, particularly Paris, Berlin, and St Petersburg. The cab was introduced to other British Empire cities and to the United States during the late 19th century, being most commonly used in New York City. The first cab service in Toronto, The City, was established in 1837 by Thornton Blackburn, Electric battery-powered taxis became available at the end of the 19th century. Bersey designed a fleet of cabs and introduced them to the streets of London on 19 August 1897. They were soon nicknamed Hummingbirds’ due to the idiosyncratic humming noise they made, in the same year in New York City, the Samuels Electric Carriage and Wagon Company began running 12 electric hansom cabs. Many telephone companies were at one time government agencies or privately owned but state-regulated monopolies. The government agencies are referred to, primarily in Europe. An Internet service provider is an organization that provides services for accessing and using the Internet. Internet service providers may be organized in various forms, such as commercial, community-owned, non-profit, Internet services typically provided by ISPs include Internet access, Internet transit, domain name registration, web hosting, Usenet service, and colocation. The Internet was developed as a network between government research laboratories and participating departments of universities, by the late 1980s, a process was set in place towards public, commercial use of the Internet. On 31 January 2015, AP News reported that the FCC will present the notion of applying Title II of the Communications Act of 1934 to the internet in a vote expected on 26 February 2015. Adoption of this notion would reclassify internet service from one of information to one of the telecommunications and, according to Tom Wheeler, chairman of the FCC, the FCC is expected to enforce net neutrality in its vote, according to the New York Times. On 26 February 2015, the FCC ruled in favor of net neutrality by adopting Title II of the Communications Act of 1934 and Section 706 in the Telecommunications Act of 1996 to the Internet. The FCC Chairman, Tom Wheeler, commented, This is no more a plan to regulate the Internet than the First Amendment is a plan to free speech. They both stand for the same concept, on 12 March 2015, the FCC released the specific details of the net neutrality rules. On 13 April 2015, the FCC published the rule on its new Net Neutrality regulations. ISPs provide Internet access, employing a range of technologies to connect users to their network, available technologies have ranged from computer modems with acoustic couplers to telephone lines, to television cable, wireless Ethernet, and fiber optics. For users and small businesses, traditional options include copper wires to provide dial-up, DSL, typically asymmetric digital subscriber line, using fiber-optics to end users is called Fiber To The Home or similar names. Canals and navigations are human-made channels for water conveyance, or to service water transport vehicles. A barge is a flat-bottomed boat, built mainly for river and canal transport of heavy goods. Freight companies are companies that specialize in the moving of freight, or cargo, from one place to another. A roller coaster is an amusement ride developed for amusement parks and modern theme parks. LaMarcus Adna Thompson obtained a patent regarding roller coasters on January 20,1885, which were out of wood. In essence a specialized railroad system, a roller coaster consists of a track that rises in designed patterns, the track does not necessarily have to be a complete circuit, as shuttle roller coasters demonstrate. Most roller coasters have multiple cars in which passengers sit and are restrained, two or more cars hooked together are called a train. Some roller coasters, notably wild mouse coasters, run with single cars. Built in the 17th century, the slides were built to a height of between 21 and 24 m, consisted of a 50-degree drop, and were reinforced by wooden supports. Disneyland Park, originally Disneyland, is the first of two theme parks built at the Disneyland Resort in Anaheim, California, opened on July 17,1955. It is the theme park designed and built under the direct supervision of Walt Disney. It was originally the attraction on the property, its name was changed to Disneyland Park to distinguish it from the expanding complex in the 1990s. Walt Disney came up with the concept of Disneyland after visiting various amusement parks with his daughters in the 1930s and 1940s. He initially envisioned building a tourist attraction adjacent to his studios in Burbank to entertain fans who wished to visit, however, after hiring a consultant to help him determine an appropriate site for his project, Disney bought a 160-acre site near Anaheim in 1953. Construction began in 1954 and the park was unveiled during a televised press event on the ABC Television Network on July 17,1955. Opened in 2001, Disney California Adventure Park was built on the site of Disneylands original parking lot, Disneyland has a larger cumulative attendance than any other theme park in the world, with over 650 million guests since it opened. In 2013, the park hosted approximately 16.2 million guests, according to a March 2005 Disney report,65,700 jobs are supported by the Disneyland Resort, including about 20,000 direct Disney employees and 3,800 third-party employees. Disneyland is dedicated to the ideals, the dreams, and the facts that have created America, with the hope that it will be a source of joy. The concept for Disneyland began when Walt Disney was visiting Griffith Park in Los Angeles with his daughters Diane and Sharon. While watching them ride the merry-go-round, he came up with the idea of a place where adults and their children could go and have fun together and he may have also been influenced by his fathers memories of the Worlds Columbian Exposition of 1893 in Chicago. Another likely influence was Benton Harbor, Michigans nationally famous House of Davids Eden Springs Park, Disney visited the park and ultimately bought one of the older miniature trains originally used there, the colony had the largest miniature railway setup in the world at the time. His ideas evolved to a play park with a boat ride. The initial concept, the Mickey Mouse Park, started with an 8-acre plot across Riverside Drive and his designers began working on concepts, though the project grew much larger than the land could hold. Disney hired Harrison Price from Stanford Research Institute to gauge the proper area to locate the theme based on the areas potential growth. To have legal personality means to be capable of holding legal rights and obligations within a certain legal system, such as entering into contracts, suing, and being sued. Legal personality is a prerequisite to legal capacity, the ability of any person to amend rights. In international law, consequently, legal personality is a prerequisite for an organization to be able to sign international treaties in its own name. A holder of legal personality is called as a person, Persons are of two kinds, natural persons and juridical persons – entities such as corporations, which are treated in law as if they are persons. While human beings acquire legal personhood when they are born, juridical persons do so when they are incorporated in accordance with law, artificial personality, juridical personality, or juristic personality is the characteristic of a non-living entity regarded by law to have the status of personhood. A juridical or artificial person has a name and has certain rights, protections, privileges, responsibilities. The concept of a person is a fundamental legal fiction. It is pertinent to the philosophy of law, as it is essential to laws affecting a corporation, juridical personality allows one or more natural persons to act as a single entity for legal purposes. In many jurisdictions, artificial personality allows that entity to be considered under law separately from its individual members and they may sue and be sued, enter contracts, incur debt, and own property. Entities with legal personality may also be subjected to legal obligations. An entity with legal personality may shield its members from personal liability, in some common law jurisdictions a distinction is drawn between corporation aggregate and a corporation sole. Historically most corporations sole were ecclesiastical in nature, but a number of public offices are now formed as corporations sole. The concept of personality is not absolute. Aircraft were first used for carrying mail as cargo in 1911, eventually manufacturers started designing aircraft for other types of freight as well. Rail line

Rail terminology is a form of technical terminology. The difference between the American term railroad and the term railway is the most significant difference in rail terminology. There are also others, due to the development of rail transport systems in different parts of the world. Various global terms are presented here, where a term has multiple names, the abbreviation UIC refers to standard terms adopted by the International Union of Railways in its official publications and thesaurus. Instead, an alarm is sounded at an interval in which the operator must respond by pressing a button to reset the alarm. If the operator does not respond within a time, the prime mover is automatically throttled back to idle. They also serve to support the arch or equivalent. The only significant difference is the size, measured in feet rather than inches, the fireman remains with the locomotive and, when the driver is at the other end, the fireman controls the cut off and vacuum ejectors in addition to his usual duties. Axlebox or axle box The housing that holds the bearings of a locomotive The housing attaching the end of the axle to the bogie which contains the bearing allowing the axle to rotate. Bad order A tag or note applied to a piece of equipment. Generally, equipment tagged as bad order is not to be used until repairs are performed, revolving masses can easily be balanced by counterweights, but the balancing of reciprocating parts is a matter of compromise and judgement. Balloon A looped length of track, usually at the end of a spur or branch, can be used as part of a freight installation to allow the loading or unloading of bulk materials without the need to stop the train. Early locomotives burned coke, provision of an arch was necessary before coal could be used without producing excessive smoke. Many early railroads were broad gauge, for example the Great Western Railway in the UK which adopted 7 ft gauge until it was converted to standard gauge in the 1860s - 1890s, russia still has over 80,000 km of broad gauge railroads. Broad gauge is also normal in Spain and Portugal, in India, as well as Ireland, cabless A locomotive without a cab. Commonly referred to as a B unit or a Slug, although not all Slugs are cabless, caboose A railroad car attached usually to the end of a train, in which railroad workers could ride and monitor track and rolling stock conditions. Largely obsolete, having been replaced by the electronic end-of-train device, the correct classification is CoCo, but Co-Co is used more often. Commuter rail
–
Trains operate following a schedule, at speeds varying from 50 to 200 km/h. Distance charges or zone pricing may be used and they primarily serve lower density suburban areas, and often share right-of-way with intercity or freight trains. Some services operate only during peak hours and others uses fewer departures during off peak hours, average speeds are high, often 50 km/h or higher. These higher speeds better serve the longer distances involved, some services include express services which skip some stations in order to run faster and separate longer distance riders from short-distance ones. The general range of commuter trains distance varies between 15 and 200 km, sometimes long distances can be explained by that the train runs between two or several cities. Distances between stations may vary, but are much longer than those of urban rail systems. In city centers the train either has a station or passes through the city centre with notably fewer station stops than those of urban rail systems. Toilets are often available on trains and in stations. Their ability to coexist with freight or intercity services in the same right-of-way can drastically reduce system construction costs, however, frequently they are built with dedicated tracks within that right-of-way to prevent delays, especially where service densities have converged in the inner parts of the network. Most such trains run on the standard gauge track. Some light rail systems may run on a narrower gauge, some countries, including Finland, India, Pakistan, Russia, Brazil and Sri Lanka, as well as San Francisco in the USA and Melbourne and Adelaide in Australia, use broad gauge track. The fact that the terminology is not standardised across countries further complicates matters, most S-bahns typically behave like commuter rail with most trackage not separated from other trains, and long lines with trains running between cities and suburbs rather than within a city. The distances between stations however, are usually short, in larger systems there is usually a high frequency metro-like central corridor in the city center where all the lines converge into. Typical examples of large city S-Bahns include Munich and Frankfurt, S-Bahns do also exist in some mid-size cities like Rostock and Magdeburg but behave more like typical commuter rail with lower frequencies and very little exclusive trackage. A similar network exists in Copenhagen called the S-tog, in Hamburg and Copenhagen, other, diesel driven trains, do continue where the S-Bahn ends. Regional rail usually provides rail services between towns and cities, rather than purely linking major population hubs in the way inter-city rail does, Regional rail operates outside major cities. Unlike Inter-city, it stops at most or all stations between cities and it provides a service between smaller communities along the line, and also connections with long-distance services at interchange stations located at junctions or at larger towns along the line. A train is a form of rail transport consisting of a series of vehicles that usually runs along a rail track to transport cargo or passengers. Motive power is provided by a locomotive or individual motors in self-propelled multiple units. Although historically steam propulsion dominated, the most common forms are diesel and electric locomotives. Other energy sources include horses, engine or water-driven rope or wire winch, gravity, pneumatics, batteries, the word train comes from the Old French trahiner, from the Latin trahere pull, draw. There are various types of trains that are designed for particular purposes, a train may consist of a combination of one or more locomotives and attached railroad cars, or a self-propelled multiple unit. The first trains were rope-hauled, gravity powered or pulled by horses, from the early 19th century almost all were powered by steam locomotives. A passenger train is one which includes passenger-carrying vehicles which can often be very long, one notable and growing long-distance train category is high-speed rail. In order to much faster operation over 500 km/h, innovative Maglev technology has been researched for years. In most countries, such as the United Kingdom, the distinction between a tramway and a railway is precise and defined in law, a freight train uses freight cars to transport goods or materials. Freight and passengers may be carried in the train in a mixed consist. Rail cars and machinery used for maintenance and repair of tracks, etc. are termed maintenance of way equipment, similarly, dedicated trains may be used to provide support services to stations along a train line, such as garbage or revenue collection. Horse-drawn vehicles

A horse-drawn vehicle is a mechanized piece of equipment pulled by one horse or by a team of horses. These vehicles typically had two or four wheels and were used to carry passengers and/or a load and they were once common worldwide, but they have mostly been replaced by automobiles and other forms of self-propelled transport. A two-wheeled horse-drawn vehicle is a cart, four-wheeled vehicles have many names – one for heavy loads is most commonly called a wagon. Very light carts and wagons can also be pulled by donkeys, other smaller animals are occasionally used, such as large dogs, llamas and goats. Heavy wagons, carts and agricultural implements can also be pulled by other large animals such as oxen, water buffalo, yaks or even camels. Vehicles pulled by one animal have two shafts which attach either side of the rearmost animal, Vehicles which are pulled by a pair have a pole which attaches between the wheel pair. Other arrangements are possible, for example three or more abreast, a wheel pair with a single lead animal, or a wheel pair with three lead animals abreast. Very heavy loads sometimes had a team behind to slow the vehicle down steep hills. Sometimes at a hill with frequent traffic such a team would be hired to passing wagons to help them up or down the hill. Two-wheeled vehicles are balanced by the distribution of weight of the load over the axle, four-wheeled vehicles remain level on their own, and so the shafts or pole are hinged vertically, allowing them to rise and fall with the movement of the animals. Village
–
A village is a clustered human settlement or community, larger than a hamlet but smaller than a town, with a population ranging from a few hundred to a few thousand. Though often located in areas, the term urban village is also applied to certain urban neighbourhoods. Villages are normally permanent, with fixed dwellings, however, transient villages can occur, further, the dwellings of a village are fairly close to one another, not scattered broadly over the landscape, as a dispersed settlement. In the past, villages were a form of community for societies that practise subsistence agriculture. In Great Britain, a hamlet earned the right to be called a village when it built a church, in many cultures, towns and cities were few, with only a small proportion of the population living in them. The Industrial Revolution attracted people in numbers to work in mills and factories. This also enabled specialization of labor and crafts, and development of many trades, the trend of urbanization continues, though not always in connection with industrialization. Although many patterns of life have existed, the typical village was small. Homes were situated together for sociability and defence, and land surrounding the living quarters was farmed, Traditional fishing villages were based on artisan fishing and located adjacent to fishing grounds. Telecommunication is the transmission of signs, signals, messages, writings, images and sounds or intelligence of any nature by wire, radio, optical or other electromagnetic systems. Telecommunication occurs when the exchange of information between communication participants includes the use of technology and it is transmitted either electrically over physical media, such as cables, or via electromagnetic radiation. Such transmission paths are divided into communication channels which afford the advantages of multiplexing. The term is used in its plural form, telecommunications. Early means of communicating over a distance included visual signals, such as beacons, smoke signals, semaphore telegraphs, signal flags, other examples of pre-modern long-distance communication included audio messages such as coded drumbeats, lung-blown horns, and loud whistles. Zworykin, John Logie Baird and Philo Farnsworth, the word telecommunication is a compound of the Greek prefix tele, meaning distant, far off, or afar, and the Latin communicare, meaning to share. Its modern use is adapted from the French, because its use was recorded in 1904 by the French engineer. Communication was first used as an English word in the late 14th century, in the Middle Ages, chains of beacons were commonly used on hilltops as a means of relaying a signal. Beacon chains suffered the drawback that they could pass a single bit of information. One notable instance of their use was during the Spanish Armada, in 1792, Claude Chappe, a French engineer, built the first fixed visual telegraphy system between Lille and Paris. However semaphore suffered from the need for skilled operators and expensive towers at intervals of ten to thirty kilometres, as a result of competition from the electrical telegraph, the last commercial line was abandoned in 1880. Homing pigeons have occasionally used throughout history by different cultures. Pigeon post is thought to have Persians roots and was used by the Romans to aid their military, frontinus said that Julius Caesar used pigeons as messengers in his conquest of Gaul. The FCC works towards six goals in the areas of broadband, competition, the spectrum, the media, public safety and homeland security, and modernizing itself. The FCC was formed by the Communications Act of 1934 to replace the radio regulation functions of the Federal Radio Commission, the FCC took over wire communication regulation from the Interstate Commerce Commission. Communications Act of 1934
–
The Act replaced the Federal Radio Commission with the Federal Communications Commission. It also transferred regulation of telephone services from the Interstate Commerce Commission to the FCC. On January 3,1996, the 104th Congress of the United States amended or repealed sections of the Communications Act of 1934 with the new Telecommunications Act of 1996 and it was the first major overhaul of American telecommunications policy in nearly 62 years. In 1933, President Franklin D. Roosevelt asked Daniel C, roper, Secretary of Commerce, to appoint an interdepartmental committee for studying electronic communications. The Committee reported that the service, as far as congressional action is involved. A recommendation was made for the establishment of a new agency that would regulate all interstate and foreign communication by wire and radio, telegraphy, telephone, on February 26,1934, the President sent a special message to Congress urging the creation of the Federal Communications Commission. The following day Senator Clarence Dill and Representative Sam Rayburn introduced bills to carry out this recommendation, the Senate Bill passed the House on June 1,1934, and the conference report was adopted by both houses eight days later. The Communications Act was signed by President Roosevelt on June 1934, particular parts of it became effective July 1,1934, other parts on July 11,1934. And thus the FCC was born, the Communications Act of 1934 followed the precedents of trial cases set under the Commerce Clause of the U. S. Constitution, regulating commerce among the several states. In 1914 the U. S. Supreme Court set limits on price discrimination that were effectively interstate commerce in Houston, the railway was setting lower prices for intrastate carriers within Texas while charging more for carriers that were going through or out of the state. The Supreme Court ruled in favor of the ICC, and maximum prices were set to limit the damage that other states could face due to price discrimination, Communications technology was determined to be an interstate good. The goal was to have telephone and broadcasting regulated with the jurisdiction in a way similar to that in which the ICC regulates the railways. The act did not, however, allow for price regulation through the FCC due to lobbying efforts from the National Association of Regulatory Utility Commissioners. Currently there are some challenges and proposed changes to the Act, the company CellAntenna has sued the FCC claiming that the Homeland Security Act of 2002 did override the Communications Act of 1934. As the law today, the 1934 Communications Act prohibits local and state law enforcement from using jamming devices to thwart criminal. In addition, there is talk about the need for an Internet kill switch and this act removes the powers established in the 1934 Act and gives the President the authority to stop the Internet in case of a cyber attack. S. Educators wanted more of radio to be given to them, they had termed a special interest by the Federal Radio Commission. The Wagner-Hatfield amendment would have given 25% of all radio broadcasting facilities to non-profit institutions and organizations and it would also have allowed these educational stations to sell advertising in order to become self-sufficient

The Telecommunications Act of 1996 was the first significant overhaul of telecommunications law in more than sixty years, amending the Communications Act of 1934. One of the most controversial titles was Title 3, which allowed for media cross-ownership, the legislations primary goal was deregulation of the converging broadcasting and telecommunications markets. S. Communications policy, covering telecommunications and broadcasting, the Act left most regulation of intrastate telephone services to the states. In the 1970s and 1980s, a combination of change, court decisions. These changes amounted to a rollback of New Deal market regulation. Congress attempted to create a framework for the transition from primarily monopoly provision to competitive provision of telecommunications services. The Act was approved by the 104th Congress on January 3,1996 and it was the first bill signed in cyberspace and the first bill signed at the Library of Congress. A purpose of the 1996 Act was to foster competition among companies that use similar underlying network technologies to provide a type of service. For example, it creates separate regulatory regimes for carriers providing voice telephone service and providers of cable television, one key provision allowed the FCC to preempt state or local legal requirements that acted as a barrier to entry in the provision of interstate or intrastate telecommunications service. Under these conditions, many calls will arise between parties on different networks, the 1996 Act requires that intercarrier compensation rates among competing local exchange carriers be based on the “additional costs of terminating such calls”. However, the created by the 1996 Act set different intercarrier compensation rates for services that were not competing at that time. This requirement has only partially implemented, however, and therefore significant implicit universal services subsidies still remain in above-cost rates for certain services. An Internet service provider is an organization that provides services for accessing and using the Internet. Internet service providers may be organized in various forms, such as commercial, community-owned, non-profit, Internet services typically provided by ISPs include Internet access, Internet transit, domain name registration, web hosting, Usenet service, and colocation. Adoption of this notion would reclassify internet service from one of information to one of the telecommunications and, according to Tom Wheeler, chairman of the FCC, the FCC is expected to enforce net neutrality in its vote, according to the New York Times. On 26 February 2015, the FCC ruled in favor of net neutrality by adopting Title II of the Communications Act of 1934 and Section 706 in the Telecommunications Act of 1996 to the Internet. The FCC Chairman, Tom Wheeler, commented, This is no more a plan to regulate the Internet than the First Amendment is a plan to free speech. They both stand for the same concept, on 12 March 2015, the FCC released the specific details of the net neutrality rules. On 13 April 2015, the FCC published the rule on its new Net Neutrality regulations. ISPs provide Internet access, employing a range of technologies to connect users to their network, available technologies have ranged from computer modems with acoustic couplers to telephone lines, to television cable, wireless Ethernet, and fiber optics. Research suggests that a combination of policy instruments will help realize the range of valued political and economic objectives central to the network neutrality debate. Network neutrality is the principle that all Internet traffic should be treated equally, Internet traffic includes all of the different messages, files and data sent over the Internet, including, for example, emails, digital audio files, digital video files, etc. The idea of an open Internet is the idea that the resources of the Internet and means to operate on it should be easily accessible to all individuals, companies. This often includes ideas such as net neutrality, open standards, transparency, lack of Internet censorship, a closed Internet refers to the opposite situation, in which established persons, corporations or governments favor certain uses. A closed Internet may have restricted access to necessary web standards, artificially degrade some services, some countries block certain websites or types of sites and monitor and/or censor Internet use using Internet police, a specialized type of law enforcement or secret police. The concept of a network made up of dumb pipes has been around since at least the early 1990s. The term dumb network refers to a network which is set up, in 2013 the software company MetroTech Net, Inc. coined the term dumb wave, which is the 2010s-era application of the dumb pipe concept to the ubiquitous wireless network. The end-to-end principle is a principle of design was first set out in the 1981 paper End-to-end arguments in system design by Jerome H. Saltzer, David P. Reed. They argued that reliable systems tend to require end-to-end processing to operate correctly and this leads to the model of a minimal dumb network with smart terminals, a completely different model from the previous paradigm of the smart network with dumb terminals. The end-to-end principle is related, and sometimes seen as a direct precursor to the principle of net neutrality. If the core of a network has more bandwidth than is permitted to enter at the edges, for example, landline telephone network employs admission control to limit user demand on the network core by refusing to create a circuit for the requested connection. During a natural disaster, for example, most users will get a signal if they pick up a landline phone, as the phone company prioritizes 9-1-1. Over-provisioning is a form of statistical multiplexing that makes liberal estimates of peak user demand, over-provisioning is used in private networks such as WebEx and the Internet 2 Abilene Network, an American university network. David Isenberg believes that continued over-provisioning will always provide more capacity for less expense than QoS, discrimination by protocol is the favoring or blocking information based on aspects of the communications protocol that the computers are using to communicate. The Digital Millennium Copyright Act is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization. It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works and it also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. In addition, the DMCA heightens the penalties for infringement on the Internet. The DMCAs principal innovation in the field of copyright is the exemption from direct and indirect liability of Internet service providers and this exemption was adopted by the European Union in the Electronic Commerce Directive 2000. The Copyright Directive 2001 implemented the 1996 WIPO Copyright Treaty in the EU, the treaties have two major portions. One portion includes works covered by treaties in U. S. copy prevention laws. For further analysis of this portion of the Act and of cases under it, see WIPO Copyright and Performances, the second portion is often known as the DMCA anti-circumvention provisions. The section contains a number of limitations and exemptions, for such things as government research. The section does not include a fair use exemption from criminality nor a scienter requirement, OCILLA also includes a counternotification provision that offers OSPs a safe harbor from liability to their users when users claim that the material in question is not, in fact, infringing. OCILLA also facilitates issuing of subpoenas against OSPs to provide their users identity, DMCA Title III modified section 117 of the copyright title so that those repairing computers could make certain temporary, limited copies while working on a computer. Highly toxic ammonia is theoretically the most dangerous substance to be transported through long-distance pipelines, hydrogen pipeline transport is the transportation of hydrogen through a pipe. District heating or teleheating systems use a network of insulated pipes which transport heated water, pipelines conveying flammable or explosive material, such as natural gas or oil, pose special safety concerns and there have been various accidents. Pipelines can be the target of vandalism, sabotage, or even terrorist attacks, in war, pipelines are often the target of military attacks. It is uncertain when the first crude oil pipeline was built, pipelines are generally the most economical way to transport large quantities of oil, refined oil products or natural gas over land. Natural gas are lightly pressurized into liquids knows as Natural Gas Liquids, small NGL processing facilities can be located in oil fields so the butane and propane liquid under light pressure of 125 pounds per square inch, can be shipped by rail, truck or pipeline. Propane can be used as a fuel in oil fields to heat various facilities used by the oil drillers or equipment and trucks used in the oil patch. EG, Propane will convert from a gas to a liquid under pressure,100 psi, give or take depending on temperature. Pipelines and rail cars use about double that pressure to pump at 250 psi, the distance to ship propane to markets is much shorter, as thousands of natural-gas processing plants are located in or near oil fields. Compared to shipping by railroad, pipelines have lower cost per unit, pipelines are preferable to transportation by truck for a number of reasons. Employment on completed pipelines represents only 1% of that of the trucking industry and this allows the Bakken Basin and Three Forks oil producers to get higher negotiated prices for their oil because they will not be restricted to just one wholesale market in the US. International law is the set of rules generally regarded and accepted as binding in relations between states and between nations. It serves as a framework for the practice of stable and organized international relations, International law differs from state-based legal systems in that it is primarily applicable to countries rather than to private citizens. National law may become law when treaties delegate national jurisdiction to supranational tribunals such as the European Court of Human Rights or the International Criminal Court. Treaties such as the Geneva Conventions may require national law to conform to respective parts, much of international law is consent-based governance. This means that a member is not obliged to abide by this type of international law. This is an issue of state sovereignty, however, other aspects of international law are not consent-based but still are obligatory upon state and non-state actors such as customary international law and peremptory norms. The term international law can refer to three distinct legal disciplines, Public international law, which governs the relationship between states and international entities. It includes these legal fields, treaty law, law of sea, international law, the laws of war or international humanitarian law, international human rights law. Private international law, or conflict of laws, which addresses the questions of jurisdiction may hear a case. The two traditional branches of law are, jus gentium – law of nations jus inter gentes – agreements between nations. Several legal systems developed in Europe, including the systems of continental European states and English common law, based on decisions by judges. Some doubt the effectiveness of law, as they see the implementation of international law as a policy option among others to tackle global dilemmas. They say that international law must be evaluated with other, possibly more effective, International law is sourced from decision makers and researchers looking to verify the substantive legal rule governing a legal dispute or academic discourse. The sources of law applied by the community of nations to find the content of international law are listed under Article 38. Many scholars agree that the fact that the sources are arranged sequentially in the Article 38 of the ICJ Statute suggests a hierarchy of sources. The Hague–Visby Rules is a set of international rules for the international carriage of goods by sea. They are an updated version of the original Hague Rules which were drafted in Brussels in 1924. The official title of the Hague Rules the International Convention for the Unification of Certain Rules of Law relating to Bills of Lading, after being amended by the Brussels Amendments in 1968, the Rules became known colloquially as the Hague–Visby Rules. A final amendment was made in the SDR Protocol in 1979, many countries declined to adopt the Hague-Visby Rules and stayed with the 1924 Hague Rules. Some other countries which upgraded to Hague-Visby subsequently failed to adopt the 1979 SDR protocol. The Hague–Visby Rules were incorporated into English law by the Carriage of Goods by Sea Act 1971, for instance, although Article I of the Rules exempts live animals and deck cargo, section 1 restores those items into the category of goods. If the Rules apply, the text of Rules is incorporated into the contract of carriage. Under the Rules, the main duties are to properly and carefully load, handle, stow, carry, keep, care for. The Interstate Commerce Commission was a regulatory agency in the United States created by the Interstate Commerce Act of 1887. Congress expanded ICC authority to other modes of commerce beginning in 1906. The agency was abolished in 1995, and its functions were transferred to the Surface Transportation Board. The Commissions five members were appointed by the President with the consent of the United States Senate and this was the first independent agency. The ICC was established by the Interstate Commerce Act of 1887, the creation of the commission was the result of widespread and longstanding anti-railroad agitation. A central issue was rate discrimination between similarly situated customers and communities, various sections of the Interstate Commerce Act banned personal discrimination and required shipping rates to be just and reasonable. President Cleveland appointed Thomas M. Cooley as the first chairman of the ICC, Cooley had been Dean of the University of Michigan Law School and Chief Justice of the Michigan Supreme Court. The Commission had a troubled start because the law that created it failed to give it adequate enforcement powers, the Commission is, or can be made, of great use to the railroads. It satisfies the popular clamor for a government supervision of the railroads, - William H. H. Miller, US Attorney General, circa 1889. Following passage of the 1887 act, the ICC proceeded to set maximum shipping rates for railroads, however, in the late 1890s several railroads challenged the agencys ratemaking authority in litigation, and the courts severely limited the ICCs powers. Congress expanded the powers through subsequent legislation. The 1893 Railroad Safety Appliance Act gave the ICC jurisdiction over railroad safety, removing this authority from the states, and this was followed with amendments in 1903 and 1910. The Hepburn Act of 1906 authorized the ICC to set railroad rates. A long-standing controversy was how to interpret language in the Act that banned long haul-short haul fare discrimination, the Valuation Act of 1913 required the ICC to organize a Bureau of Valuation that would assess the value of railroad property. This information would be used to set rates, in 1934, Congress transferred the telecommunications authority to the new Federal Communications Commission. In 1935, Congress passed the Motor Carrier Act, which extended ICC authority to regulate interstate bus lines and trucking as common carriers. Between 1920 and 1923, William Z. Motor Carrier Act of 1980

The Motor Carrier Regulatory Reform and Modernization Act, more commonly known as the Motor Carrier Act of 1980 is a United States federal law which deregulated the trucking industry. Increasing public interest in deregulation led to a series of laws beginning in 1976 with the Railroad Revitalization. The deregulation of the industry began with the Motor Carrier Act of 1980. The MCA was envisioned to be a sweeping de-regulation of the trucking industry, when President Carter signed the bill, he proclaimed, This is historic legislation. It will remove 45 years of excessive and inflationary Government restrictions and it will have a powerful anti-inflationary effect, reducing consumer costs by as much as $8 billion each year. And by ending wasteful practices, it will conserve annually hundreds of millions of gallons of precious fuel, all the citizens of our Nation will benefit from this legislation. Consumers will benefit, because almost every product we purchase has been shipped by truck, the shippers who use trucking will benefit as new service and price options appear. Labor will benefit from increased job opportunities, and the trucking industry itself will benefit from greater flexibility and new opportunities for innovation. A particularly interesting aspect of legislation is that it was implemented more aggressively than it was written. Promoting independent pricing and open entry were critical to achieving a level of competition made possible by the characteristics of the trucking industry, under Darius Gaskins, the Chair of the Interstate Commerce Commission in the period immediately following passage of this Act, entry controls were dramatically reduced. Before this law was passed, the industry had passed along higher wages. The law had far-reaching consequences, causing a general price reduction for consumer packaged goods, the law had far-reaching consequences, causing price competition and lower profit margins. Critics of the legislation argue that most of the decline in prices comes from decreased incomes of truck drivers, a result of the law was that the number of new firms has increased dramatically, especially low-cost, non-union carriers. By 1990 the number of licensed carriers exceeded forty thousand, more than double the number in 1980, combined with the Staggers Act, intermodal freight transport surged, expanding 70 percent between 1981 and 1986. The United States Reports are the official record of the rulings, orders, case tables, and other proceedings of the Supreme Court of the United States. Opinions of the court in each case, prepended with a prepared by the Reporter of Decisions. For lawyers, citations to United States Reports are the reference for Supreme Court decisions. Following Bluebook, a commonly accepted citation protocol, the case Brown, et al. v. Board of Education of Topeka, Kansas, for example, would be cited as, Brown v. Bd. of Educ. The early volumes of the United States Reports were originally published privately by the individual Supreme Court Reporters, as was the practice in England, the reports were designated by the names of the reporters who compiled them, Dallass Reports, Cranchs Reports, etc. The decisions appearing in the entire first volume and most of the volume of United States Reports are not decisions of the United States Supreme Court. Instead, they are decisions from various Pennsylvania courts, dating from the colonial period, alexander Dallas, a lawyer and journalist, of Philadelphia, Pennsylvania, had been in the business of reporting these cases for newspapers and periodicals. He subsequently began compiling his case reports in a bound volume and this would come to be known as the first volume of Dallas Reports. Dallas continued to collect and publish Pennsylvania decisions in a volume of his Reports. When the Supreme Court began hearing cases, he added those cases to his reports, starting towards the end of the volume,2 Dallas Reports. Dallas went on to publish a total of four volumes of decisions during his tenure as Reporter, when the Supreme Court moved to Washington, D. C. in 1800, Dallas remained in Philadelphia, and William Cranch took over as unofficial reporter of decisions. In 1817, Congress made the Reporter of Decisions an official, salaried position, in 1874, the U. S. government began to fund the reports publication, creating the United States Reports. The earlier, private reports were retroactively numbered volumes 1–90 of the United States Reports, therefore, decisions appearing in these early reports have dual citation forms, one for the volume number of the United States Reports, and one for the set of nominate reports. Wikisource is an online digital library of free content textual sources on a wiki, operated by the Wikimedia Foundation. Wikisource is the name of the project as a whole and the name for each instance of that project, the projects aims are to host all forms of free text, in many languages, and translations. Originally conceived as an archive to store useful or important historical texts, the project officially began in November 24,2003 under the name Project Sourceberg. The name Wikisource was adopted later that year and it received its own domain name seven months later, the project has come under criticism for lack of reliability but it is also cited by organisations such as the National Archives and Records Administration. The project holds works that are either in the domain or freely licensed, professionally published works or historical source documents, not vanity products. Verification was initially made offline, or by trusting the reliability of digital libraries. Now works are supported by online scans via the ProofreadPage extension, some individual Wikisources, each representing a specific language, now only allow works backed up with scans. While the bulk of its collection are texts, Wikisource as a whole hosts other media, some Wikisources allow user-generated annotations, subject to the specific policies of the Wikisource in question. Wikisources early history included several changes of name and location, the original concept for Wikisource was as storage for useful or important historical texts. These texts were intended to support Wikipedia articles, by providing evidence and original source texts. The collection was focused on important historical and cultural material. The project was originally called Project Sourceberg during its planning stages, in 2001, there was a dispute on Wikipedia regarding the addition of primary source material, leading to edit wars over their inclusion or deletion. Project Sourceberg was suggested as a solution to this, perhaps Project Sourceberg can mainly work as an interface for easily linking from Wikipedia to a Project Gutenberg file, and as an interface for people to easily submit new work to PG. Wed want to complement Project Gutenberg--how, exactly, and Jimmy Wales adding like Larry, Im interested that we think it over to see what we can add to Project Gutenberg. It seems unlikely that primary sources should in general be editable by anyone -- I mean, Shakespeare is Shakespeare, unlike our commentary on his work, the project began its activity at ps. wikipedia. org. Administrative law

Administrative law is the body of law that governs the activities of administrative agencies of government. Government agency action can include rulemaking, adjudication, or the enforcement of a regulatory agenda. Administrative law is considered a branch of public law, civil law countries often have specialized courts, administrative courts, that review these decisions. In Brazil, unlike most Civil-law jurisdictions, there is no specialized court or section to deal with administrative cases, in 1998, a constitutional reform, led by the government of the President Fernando Henrique Cardoso, introduced regulatory agencies as a part of the executive branch. The President of the Republic exercises the function, in collaboration with several Ministries or other authorities with ministerial rank. Each Ministry has one or more under-secretary that performs through public services the actual satisfaction of public needs, there is not a single specialized court to deal with actions against the Administrative entities, but instead there are several specialized courts and procedures of review. Administrative law in the Peoples Republic of China was virtually non-existent before the reform era initiated by Deng Xiaoping. In 1990, the Administrative Supervision Regulations and the Administrative Reconsideration Regulations were passed, the three regulations have been amended and upgraded into laws. In 1994, the State Compensation Law was passed, followed by the Administrative Penalties Law in 1996, Administrative Compulsory Law was enforced in 2012. Adiministrative Litigation Law was amended in 2014. The General Administrative Procedure Law is under way, the main administrative courts are the tribunaux administratifs and appeal courts are the cours administratives dappel. Special administrative courts include the National Court of Asylum Right as well as military, the French body of administrative law is called droit administratif. It is a part of the law, which deals with the organization, the tasks. Administrative law in Germany follows three basic principles, principle of the legality of the authority, which means that there is no acting against the law and no acting without a law. The general administration law is ruled in the Administrative Procedures Law. Other legal sources are the Rules of the Administrative Courts, the security code. The Verwaltungsverfahrensgesetz, which was enacted in 1977, regulates the main administrative procedures of the federal government and it serves the purpose to ensure a treatment in accordance with the rule of law by the public authority. Furthermore, it contains the regulations for mass processes and expands the legal protection against the authorities, the VwVfG basically applies for the entire public administrative activities of federal agencies as well as federal state authorities, in case of making federal law. Constitutional law is the body of law which defines the relationship of different entities within a state, namely, the executive, the legislature, and the judiciary. Not all nation states have codified constitutions, though all such states have a jus commune, or law of the land and these may include customary law, conventions, statutory law, judge-made law, or international rules and norms. Constitutional law deals with the principles by which the government exercises its authority. In some instances, these principles grant specific powers to the government, such as the power to tax, other times, constitutional principles act to place limits on what the government can do, such as prohibiting the arrest of an individual without sufficient cause. In most nations, including the United States, constitutional law is based on the text of a document ratified at the time the nation came into being, Constitutional laws may often be considered second order rule making or rules about making rules to exercise power. It governs the relationships between the judiciary, the legislature and the executive with the bodies under its authority, one of the key tasks of constitutions within this context is to indicate hierarchies and relationships of power. Human rights or civil liberties form a part of a countrys constitution. Most jurisdictions, like the United States and France, have a codified constitution, a recent example is the Charter of Fundamental Rights of the European Union which was intended to be included in the Treaty establishing a Constitution for Europe, that failed to be ratified. Perhaps the most important example is the Universal Declaration of Human Rights under the UN Charter and these are intended to ensure basic political, social and economic standards that a nation state, or intergovernmental body is obliged to provide to its citizens but many do include its governments. Some countries like the United Kingdom have no entrenched document setting out fundamental rights, in those jurisdictions the constitution is composed of statute, case law, a case named Entick v. Carrington is a constitutional principle deriving from the common law. John Enticks house was searched and ransacked by Sherriff Carrington, Carrington argued that a warrant from a Government minister, the Earl of Halifax was valid authority, even though there was no statutory provision or court order for it. The court, led by Lord Camden stated that, The great end and that right is preserved sacred and incommunicable in all instances, where it has not been taken away or abridged by some public law for the good of the whole. By the laws of England, every invasion of private property, if no excuse can be found or produced, the silence of the books is an authority against the defendant, and the plaintiff must have judgment. The commonwealth and the civil law jurisdictions do not share the same constitutional law underpinnings, another main function of constitutions may be to describe the procedure by which parliaments may legislate. For instance, special majorities may be required to alter the constitution, in bicameral legislatures, there may be a process laid out for second or third readings of bills before a new law can enter into force. Alternatively, there may further be requirements for maximum terms that a government can keep power before holding an election, Constitutional law is a major focus of legal studies and research. The doctrine of the rule of law dictates that government must be conducted according to law and this was first established by British legal theorist A. V. Dicey. Contract

A contract is a voluntary arrangement between two or more parties that is enforceable by law as a binding legal agreement. Contract is a branch of the law of obligations in jurisdictions of the civil law tradition, Contract law concerns the rights and duties that arise from agreements. A contract arises when the parties agree that there is an agreement, formation of a contract generally requires an offer, acceptance, consideration, and a mutual intent to be bound. Each party to a contract must have capacity to enter the agreement, minors, intoxicated persons, and those under a mental affliction may have insufficient capacity to enter a contract. Some types of contracts may require formalities, such as a memorialization in writing, at common law, the elements of a contract are offer, acceptance, intention to create legal relations, and consideration. Not all agreements are necessarily contractual, as the parties generally must be deemed to have an intention to be legally bound, a so-called gentlemens agreement is one which is not intended to be legally enforceable, and which is binding in honour only. In order for a contract to be formed, the parties must reach mutual assent and this is typically reached through offer and an acceptance which does not vary the offers terms, which is known as the mirror image rule. An offer is a statement of the offerors willingness to be bound should certain conditions be met. If a purported acceptance does vary the terms of an offer, it is not an acceptance but a counteroffer and, therefore, the Uniform Commercial Code disposes of the mirror image rule in §2-207, although the UCC only governs transactions in goods in the USA. As a court cannot read minds, the intent of the parties is interpreted objectively from the perspective of a reasonable person and it is important to note that where an offer specifies a particular mode of acceptance, only an acceptance communicated via that method will be valid. Contracts may be bilateral or unilateral, a bilateral contract is an agreement in which each of the parties to the contract makes a promise or set of promises to each other. For example, in a contract for the sale of a home, less common are unilateral contracts in which one party makes a promise, but the other side does not promise anything. In these cases, those accepting the offer are not required to communicate their acceptance to the offeror, in a reward contract, for example, a person who has lost a dog could promise a reward if the dog is found, through publication or orally. The payment could be conditioned on the dog being returned alive. Those who learn of the reward are not required to search for the dog, but if someone finds the dog and delivers it, the High Court of Australia stated that the term unilateral contract is unscientific and misleading. In certain circumstances, a contract may be created. A contract is implied in fact if the circumstances imply that parties have reached an agreement even though they have not done so expressly, quantum meruit claims are an example. Criminal law
–
Criminal law is the body of law that relates to crime. It regulates social conduct and proscribes whatever is threatening, harmful, or otherwise endangering to the property, health, safety and it includes the punishment of people who violate these laws. Criminal law varies according to jurisdiction, and differs from civil law, the first civilizations generally did not distinguish between civil law and criminal law. The first written codes of law were designed by the Sumerians, another important early code was the Code Hammurabi, which formed the core of Babylonian law. Only fragments of the criminal laws of Ancient Greece have survived, e. g. those of Solon. In Roman law, Gaiuss Commentaries on the Twelve Tables also conflated the civil and criminal aspects, assault and violent robbery were analogized to trespass as to property. Breach of such laws created an obligation of law or vinculum juris discharged by payment of compensation or damages. The criminal law of imperial Rome is collected in Books 47–48 of the Digest, the first signs of the modern distinction between crimes and civil matters emerged during the Norman Invasion of England. The development of the state dispensing justice in a court clearly emerged in the century when European countries began maintaining police services. From this point, criminal law had formalized the mechanisms for enforcement, Criminal law is distinctive for the uniquely serious potential consequences or sanctions for failure to abide by its rules. Every crime is composed of criminal elements, capital punishment may be imposed in some jurisdictions for the most serious crimes. Physical or corporal punishment may be imposed such as whipping or caning, individuals may be incarcerated in prison or jail in a variety of conditions depending on the jurisdiction. Length of incarceration may vary from a day to life, government supervision may be imposed, including house arrest, and convicts may be required to conform to particularized guidelines as part of a parole or probation regimen.
