Legitimacy (family law)
Legitimacy, in traditional Western common law, is the status of a child born to parents who are married to each other, of a child conceived before the parents obtain a legal divorce. Conversely, illegitimacy has been the status of a child born outside marriage, such a child being known as a bastard, or love child, when such a distinction has been made from other children. In Scots law, the terminology of natural son or natural daughter has the same implications; the prefix "Fitz-" added to a surname sometimes denoted that the child's parents were not married at the time of birth. Depending on local legislation, legitimacy can affect a child's rights of inheritance to the putative father's estate and the child's right to bear the father's surname or hereditary title. Illegitimacy has had consequences for the mother's and child's right to support from the putative father; the importance of legitimacy has decreased in Western countries with the increasing economic independence of women, the sexual revolution of the 1960s and 1970s, the fall of totalitarian regimes, declining influence of Christian churches on family life.
Births outside marriage represent the majority in many countries in Western Europe and in former European colonies. In many Western-derived cultures, stigma based on parents' marital status, use of the word "bastard", are now considered offensive. England's Statute of Merton stated, regarding illegitimacy: "He is a bastard, born before the marriage of his parents." This definition applied to situations when a child's parents could not marry, as when one or both were married or when the relationship was incestuous. The Poor Law of 1576 formed the basis of English bastardy law, its purpose was to punish a bastard child's mother and putative father, to relieve the parish from the cost of supporting mother and child. "By an act of 1576, it was ordered that bastards should be supported by their putative fathers, though bastardy orders in the quarter sessions date from before this date. If the genitor could be found he was put under great pressure to accept responsibility and to maintain the child."Under English law, a bastard could not inherit real property and could not be legitimized by the subsequent marriage of father to mother.
There was one exception: when his father subsequently married his mother, an older illegitimate son took possession of his father's lands after his death, he would pass the land on to his own heirs on his death, as if his possession of the land had been retroactively converted into true ownership. A younger non-bastard brother would have no claim to the land. There were many "natural children" of Scotland's monarchy granted positions which founded prominent families. In the 14th century, Robert II of Scotland gifted one his illegitimate sons estates in Bute, founding the Stewarts of Bute, a natural son of Robert III of Scotland was ancestral to the Shaw Stewarts of Greenock. In Scots law an illegitimate child, a "natural son" or "natural daughter", would be legitimated by the subsequent marriage of his parents, provided they were free to marry at the date of the conception; the Legitimation Act 1968 extended legitimation by the subsequent marriage of the parents to children conceived when their parents were not free to marry, but this was repealed in 2006 by the amendment of section 1 of the Law Reform Act 1986 which abolished the status of illegitimacy stating that " No person whose status is governed by Scots law shall be illegitimate...".
The Legitimacy Act 1926 of England and Wales legitimized the birth of a child if the parents subsequently married each other, provided that they had not been married to someone else in the meantime. The Legitimacy Act 1959 extended the legitimization if the parents had married others in the meantime and applied it to putative marriages which the parents incorrectly believed were valid. Neither the 1926 nor 1959 Acts changed the laws of succession to the British throne and succession to peerage and baronetcy titles. In Scotland children legitimated by the subsequent marriage of their parents have always been entitled to succeed to peerages and baronetcies and The Legitimation Act 1968 extended this right to children conceived when their parents were not free to marry; the Family Law Reform Act 1969 allowed a bastard to inherit on the intestacy of his parents. In canon and in civil law, the offspring of putative marriages have been considered legitimate. Since 2003 in England and Wales, 2002 in Northern Ireland and 2006 in Scotland, an unmarried father has parental responsibility if he is listed on the birth certificate.
In the United States, in the early 1970s a series of Supreme Court decisions held that most common-law disabilities imposed upon illegitimacy were invalid as violations of the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Still, children born out of wedlock may not be eligible for certain federal benefits unless the child has been legitimized in the appropriate jurisdiction. Many other countries have legislatively abolished any legal disabilities of a child born out of wedlock. In France, legal reforms regarding illegitimacy began in the 1970s, but it was only in the 21st century that the principle of equality was upheld. Ştefăniţă Lupu, nicknamed Papură-Vodă, son of Vasile Lupu, was Voivode of Moldavia between 1659 and 1661, again in 1661. Appointed by the Porte as a result of his father's efforts, Ştefăniţă took over the throne at the age of 16, his rule was twice overthrown by former Wallachian Prince Constantin Şerban, who occupied Iaşi and took over as Voivode. These harassments, coupled with Ottoman demands and Tatar raids, caused a deep crisis in Moldavia, worsened by an epidemic of what was thought to be the bubonic plague; the ensuing famine accounts for Ştefăniţă's moniker: resources would have been so scarce that people resorted to grinding typha, baking it as bread. The Metropolis of Wallachia and Dobrudja, headquartered in Bucharest, Romania, is a metropolis of the Romanian Orthodox Church. The Metropolis of Ungro-Wallachia was created, in 1359, by Callistus I, the Ecumenical Patriarch of Constantinople as the most senior church office of the Patriarchate of Constantinople, covering the territory of Wallachia. In 1872, the Metropolis of Ungro-Wallachia united with the Metropolis of Moldavia to form the Romanian Orthodox Church; the Metropolis of Ungro-Wallachia, who received the title of Primate Metropolitan in 1865, became the head of the General Synod of the Romanian Orthodox Church. In 1990, it became Metropolis of Dobrudja. Bucharest is the capital and largest city of Romania, as well as its cultural and financial centre. It is located in the southeast of the country, at 44°25′57″N 26°06′14″E, on the banks of the Dâmbovița River, less than 60 km north of the Danube River and the Bulgarian border. Bucharest was first mentioned in documents in 1459, it became the capital of Romania in 1862 and is the centre of Romanian media and art. Its architecture is a mix of historical, communist era and modern. In the period between the two World Wars, the city's elegant architecture and the sophistication of its elite earned Bucharest the nickname of "Little Paris". Although buildings and districts in the historic city centre were damaged or destroyed by war and above all Nicolae Ceaușescu's program of systematization, many survived and have been renovated. In recent years, the city has been experiencing an cultural boom. In 2016, the historical city centre was listed as "endangered" by the World Monuments Watch. According to the 2011 census, 1,883,425 inhabitants live within the city limits, a decrease from the 2002 census.
Adding the satellite towns around the urban area, the proposed metropolitan area of Bucharest would have a population of 2.27 million people. According to Eurostat, Bucharest has a functional urban area of 2,412,530 residents. Bucharest is the sixth-largest city in the European Union by population within city limits, after London, Madrid and Paris. Economically, Bucharest is the most prosperous city in Romania and is one of the main industrial centres and transportation hubs of Eastern and Central Europe; the city has big convention facilities, educational institutes, cultural venues, traditional "shopping arcades", recreational areas. The city proper is administratively known as the "Municipality of Bucharest", has the same administrative level as that of a national county, being further subdivided into six sectors, each governed by a local mayor; the Romanian name București has an unverified origin. Tradition connects the founding of Bucharest with the name of Bucur, a prince, an outlaw, a fisherman, a shepherd or a hunter, according to different legends.
In Romanian, the word stem bucurie means "joy", it is believed to be of Dacian origin, hence the city Bucharest means "city of joy". Other etymologies are given by early scholars, including the one of an Ottoman traveller, Evliya Çelebi, who said that Bucharest was named after a certain "Abu-Kariș", from the tribe of "Bani-Kureiș". In 1781, Austrian historian Franz Sulzer claimed that it was related to bucurie, bucuros, or a se bucura, while an early 19th-century book published in Vienna assumed its name has been derived from "Bukovie", a beech forest. In English, the city's name was rendered as Bukarest. A native or resident of Bucharest is called a "Bucharester". Bucharest's history alternated periods of development and decline from the early settlements in antiquity until its consolidation as the national capital of Romania late in the 19th century. First mentioned as the "Citadel of București" in 1459, it became the residence of the famous Wallachian prince Vlad III the Impaler; the Ottomans appointed Greek administrators to run the town from the 18th century.
A short-lived revolt initiated by Tudor Vladimirescu in 1821 led to the end of the rule of Constantinople Greeks in Bucharest. The Old Princely Court was erected by Mircea Ciobanul in the mid-16th century. Under subsequent rulers, Bucharest was established as the summer residence of the royal court. During the years to come, it competed with Târgoviște on the status of capital city after an increase in the importance of southern Muntenia brought about by the demands of the suzerain power – the Ottoman Empire. Bucharest became the permanent location of the Wallachian court after 1698. Destroyed by natural disasters and rebuilt several times during the following 200 years, hit by Caragea's plague in 1813–14, the city was wrested from Ottoman control and occupied at several intervals by the Habsburg Monarchy and Imperial Russia, it was placed under Russian administration between 1828 and the Crimean War, with an interlude during the Bucharest-centred 1848 Wallachian revolution. An Austrian garrison took possession after the Russian departure.
On 23 March 1847, a fire consumed about 2,000 buildings. In 1862, after Wallachia and Moldavia were united to form the Principality of Romania, Bucharest became the new nation's capital city. In 1881, it became the political centre of the newly proclaimed Kingdom of Romania under King Carol I. During the second half of the 19th century, the city's population increased and a new period of urban development began. During this period, gas lighting, horse-drawn trams, limited electrification were introduced; the Dâmbovița River was massively channelled in 1883, thus putting a stop to endemic floods like the 1865 flooding of Bucharest. The Fortifications of Bucharest were built; the extravagant architecture and cosmopolitan high culture of this period won Bucharest the nickname of "Little Paris" of the east, with Calea Victoriei as its Champs-Élysées. Moldavia is a historical region and former principality in Central and Eastern Europe, corresponding to the territory between the Eastern Carpathians and the Dniester River. An independent and autonomous state, it existed from the 14th century to 1859, when it united with Wallachia as the basis of the modern Romanian state; the region of Pokuttya was part of it for a period of time. The western half of Moldavia is now part of Romania, the eastern side belongs to the Republic of Moldova, the northern and southeastern parts are territories of Ukraine; the original and short-lived reference to the region was Bogdania, after Bogdan I, the founding figure of the principality. The names Moldova are derived from the name of the Moldova River. Dragoș was accompanied by his female hound called Molda; the dog's name would have been extended to the country. The old German Molde, meaning "open-pit mine" the Gothic Mulda meaning "dust", "dirt", referring to the river. A Slavic etymology, marking the end of one Slavic genitive form, denoting ownership, chiefly of feminine nouns.
A landowner named Alexa Moldaowicz is mentioned in a 1334 document as a local boyar in service to Yuriy II of Halych. In several early references, "Moldavia" is rendered under the composite form Moldo-Wallachia. Ottoman Turkish references to Moldavia included Boğdan Boğdan. See names in other languages; the name of the region in other languages include French: Moldavie, German: Moldau, Hungarian: Moldva, Russian: Молдавия, Turkish: Boğdan Prensliği, Greek: Μολδαβία. The inhabitants of Moldova were Christians. Archaeological works revealed the remains of a Christian necropolis at Mihălășeni, Botoșani county, from the 5th century; the place of worship, the tombs had Christian characteristics. The place of worship had a rectangular form with sides of seven meters. Similar necropolises and places of worship were found at Nicolina, in IașiThe Bolohoveni, is mentioned by the Hypatian Chronicle in the 13th century; the chronicle shows that this land is bordered on the principalities of Halych and Kiev.
Archaeological research identified the location of 13th-century fortified settlements in this region. Alexandru V. Boldur identified Voscodavie, Voloscovti, Volcovti and their other towns and villages between the middle course of the rivers Nistru/Dniester and Nipru/Dnieper; the Bolohoveni disappeared from chronicles after their defeat in 1257 by Daniel of Galicia's troops. Their ethnic identity is uncertain. In the early 13th century, the Brodniks, a possible Slavic–Vlach vassal state of Halych, were present, alongside the Vlachs, in much of the region's territory. Somewhere in the 11th century, a Viking named Rodfos was killed by Vlachs in the area of what will become Moldavia. In 1164, the future Byzantine emperor Andronikos I Komnenos, was taken prisoner by Vlach shepherds around the same region. Friar William of Rubruck, who visited the court of the Great Khan in the 1250s, listed "the Blac", or Vlachs, among the peoples who paid tribute to the Mongols, but the Vlachs' territory is uncertain.
Rubruck described "Blakia" as "Assan's territory" south of the Lower Danube, showing that he identified it with the northern regions of the Second Bulgarian Empire. In the 14th century, King Charles I of Hungary attempted to expand his realm and the influence of the Catholic Church eastwards after the fall of Cuman rule, ordered a campaign under the command of Phynta de Mende. In 1342 and 1345, the Hungarians were victorious in a battle against Tatar-Mongols; the Polish chronicler Jan Długosz mentioned Moldavians as having joined a military expedition in 1342, under King Władysław I, against the Margraviate of Brandenburg. In 1353, Dragoș, mentioned as a Vlach Knyaz in Maramureș, was sent by Louis I to establish a line of defense against the Golden Horde forces of Mongols on the Siret River; this expedition resulted in a polity vassal to Hungary, centered around Baia. Bogdan of Cuhea, another Vlach voivode from Maramureș who had fallen out with the Hungarian king, crossed the Carpathians in 1359, took control of Moldavia, succeeded in removing Moldavia from Hungarian control.

The Ottoman Empire known in Western Europe as the Turkish Empire or Turkey, was a state that controlled much of Southeast Europe, Western Asia and North Africa between the 14th and early 20th centuries. It was founded at the end of the 13th century in northwestern Anatolia in the town of Söğüt by the Oghuz Turkish tribal leader Osman I. After 1354, the Ottomans crossed into Europe, with the conquest of the Balkans, the Ottoman beylik was transformed into a transcontinental empire; the Ottomans ended the Byzantine Empire with the 1453 conquest of Constantinople by Mehmed the Conqueror. During the 16th and 17th centuries, at the height of its power under the reign of Suleiman the Magnificent, the Ottoman Empire was a multinational, multilingual empire controlling most of Southeast Europe, parts of Central Europe, Western Asia, parts of Eastern Europe and the Caucasus, North Africa and the Horn of Africa. At the beginning of the 17th century, the empire contained numerous vassal states; some of these were absorbed into the Ottoman Empire, while others were granted various types of autonomy during the course of centuries.
With Constantinople as its capital and control of lands around the Mediterranean basin, the Ottoman Empire was at the centre of interactions between the Eastern and Western worlds for six centuries. While the empire was once thought to have entered a period of decline following the death of Suleiman the Magnificent, this view is no longer supported by the majority of academic historians; the empire continued to maintain a flexible and strong economy and military throughout the 17th and much of the 18th century. However, during a long period of peace from 1740 to 1768, the Ottoman military system fell behind that of their European rivals, the Habsburg and Russian empires; the Ottomans suffered severe military defeats in the late 18th and early 19th centuries, which prompted them to initiate a comprehensive process of reform and modernisation known as the Tanzimat. Thus, over the course of the 19th century, the Ottoman state became vastly more powerful and organised, despite suffering further territorial losses in the Balkans, where a number of new states emerged.
The empire allied with Germany in the early 20th century, hoping to escape from the diplomatic isolation which had contributed to its recent territorial losses, thus joined World War I on the side of the Central Powers. While the Empire was able to hold its own during the conflict, it was struggling with internal dissent with the Arab Revolt in its Arabian holdings. During this time, atrocities were committed by the Young Turk government against the Armenians and Pontic Greeks; the Empire's defeat and the occupation of part of its territory by the Allied Powers in the aftermath of World War I resulted in its partitioning and the loss of its Middle Eastern territories, which were divided between the United Kingdom and France. The successful Turkish War of Independence against the occupying Allies led to the emergence of the Republic of Turkey in the Anatolian heartland and the abolition of the Ottoman monarchy; the word Ottoman is a historical anglicisation of the name of Osman I, the founder of the Empire and of the ruling House of Osman.
Osman's name in turn was the Turkish form of the Arabic name ʿUthmān. In Ottoman Turkish, the empire was referred to as Devlet-i ʿAlīye-yi ʿOsmānīye, or alternatively ʿOsmānlı Devleti. In Modern Turkish, it is known as Osmanlı Devleti; the Turkish word for "Ottoman" referred to the tribal followers of Osman in the fourteenth century, subsequently came to be used to refer to the empire's military-administrative elite. In contrast, the term "Turk" was used to refer to the Anatolian peasant and tribal population, was seen as a disparaging term when applied to urban, educated individuals. In the early modern period, an educated urban-dwelling Turkish-speaker, not a member of the military-administrative class would refer to himself neither as an Osmanlı nor as a Türk, but rather as a Rūmī, or "Roman", meaning an inhabitant of the territory of the former Byzantine Empire in the Balkans and Anatolia; the term Rūmī was used to refer to Turkish-speakers by the other Muslim peoples of the empire and beyond.
In Western Europe, the two names "Ottoman Empire" and "Turkey" were used interchangeably, with "Turkey" being favoured both in formal and informal situations. This dichotomy was ended in 1920–23, when the newly established Ankara-based Turkish government chose Turkey as the sole official name. Most scholarly historians avoid the terms "Turkey", "Turks", "Turkish" when referring to the Ottomans, due to the empire's multinational character; as the Seljuk Sultanate of Rum declined in the 13th century, Anatolia was divided into a patchwork of independent Turkish principalities known as the Anatolian Beyliks. One of these beyliks, in the region of Bithynia on the frontier of the Byzantine Empire, was led by the Turkish tribal leader Osman I, a figure of obscure origins from whom the name Ottoman is derived. Osman's early followers consisted both of Turkish tribal groups and Byzantine renegades, many but not all converts to Islam. Osman extended the control of his principality by conquering Byzantine towns along the Sakarya River.
It is not well understood how the early Ottomans came to dominate their
Helena, or Saint Helena, was an Empress of the Roman Empire, mother of Emperor Constantine the Great. Born the lowest of commoners in Drepana, Bithynia in Asia Minor, she became the consort of the future Roman Emperor Constantius Chlorus and the mother of the future Emperor Constantine the Great. Helena ranks as an important figure in the history of Christianity and of the world due to her influence on her son. In her final years, she made a religious tour of Syria Palaestina and Jerusalem, during which she discovered the True Cross; the Eastern Orthodox Church, Oriental Orthodox Church, Roman Catholic Church, the Anglican Communion revere her as a saint. Helena's birthplace is not known with certainty; the 6th-century historian Procopius is the earliest authority for the statement that Helena was a native Greek of Drepanum, in the province of Bithynia in Asia Minor. Her son Constantine renamed the city "Helenopolis" after her death around 330, which supports the belief that the city was her birthplace.
The Byzantinist Cyril Mango has argued that Helenopolis was refounded to strengthen the communication network around his new capital in Constantinople, was renamed to honor Helena, not to mark her birthplace. There was a Helenopolis in Palestine and a Helenopolis in Lydia; these cities, the province of Helenopontus in the Pontus, were all named after Constantine's mother. The bishop and historian Eusebius of Caesarea states that she was about 80 on her return from Palestine. Since that journey has been dated to 326–28, Helena was born from around 246 to 248. Little is known of her early life. Fourth-century sources, following Eutropius' "Breviarium," record that she came from a low background. Saint Ambrose was the first to call her a stabularia, a term translated as "stable-maid" or "inn-keeper", he makes this fact a virtue, calling Helena a bona stabularia, a "good stable-maid". Other sources those written after Constantine's proclamation as emperor, gloss over or ignore her background, it is unknown.
The historian Timothy Barnes has suggested that Constantius, while serving under Emperor Aurelian, could have met her while stationed in Asia Minor for the campaign against Zenobia. It is said that upon meeting. Barnes calls attention to an epitaph at Nicomedia of one of Aurelian's protectors, which could indicate the emperor's presence in the Bithynian region soon after 270; the precise legal nature of the relationship between Helena and Constantius is unknown. The sources are equivocal on the point, sometimes calling Helena Constantius' "wife", sometimes, following the dismissive propaganda of Constantine's rival Maxentius, calling her his "concubine". Jerome confused by the vague terminology of his own sources, manages to do both; some scholars, such as the historian Jan Drijvers, assert that Constantius and Helena were joined in a common-law marriage, a cohabitation recognized in fact but not in law. Others, like Timothy Barnes, assert that Constantius and Helena were joined in an official marriage, on the grounds that the sources claiming an official marriage are more reliable.
Helena gave birth to the future emperor Constantine I on 27 February of an uncertain year soon after 270. At the time, she was in Naissus. In order to obtain a wife more consonant with his rising status, Constantius divorced Helena some time before 289, when he married Theodora, Maximian's daughter under his command.. Helena and her son were dispatched to the court of Diocletian at Nicomedia, where Constantine grew to be a member of the inner circle. Helena never remarried and lived for a time in obscurity, though close to her only son, who had a deep regard and affection for her. Constantine was proclaimed Augustus of the Roman Empire in 306 by Constantius' troops after the latter had died, following his elevation his mother was brought back to the public life in 312, returning to the imperial court, she appears in the Eagle Cameo portraying Constantine's family commemorating the birth of Constantine's son Constantine II in the summer of 316. She received the title of Augusta in 325. According to Eusebius, her conversion to Christianity followed her son becoming emperor.
Constantine appointed his mother Helena as Augusta Imperatrix, gave her unlimited access to the imperial treasury in order to locate the relics of Judeo-Christian tradition. In 326-28 Helena undertook a trip to the Holy Places in Palestine. According to Eusebius of Caesarea, who records the details of her pilgrimage to Palestine and other eastern provinces, she was responsible for the construction or beautification of two churches, the Church of the Nativity and the Church of Eleona on the Mount of Olives, sites of Christ's birth and ascension, respectively. Local founding legend attributes to Helena's orders the construction of a church in Egypt to identify the Burning Bush of Sinai; the chapel at Saint Catherine's Monastery—often referred to as the Chapel of Saint Helen—is dated to the year AD 330. Jerusalem was still being rebuilt following the destruction caused by Titus in AD 70. Emperor Hadrian had built during the 130s a temple over the site of Jesus's tomb near Calvary, renamed the city Aelia Capitolina.
