United States Congress
The United States Congress is the bicameral legislature of the Federal Government of the United States. The legislature consists of two chambers: the House of the Senate; the Congress meets in the United States Capitol in Washington, D. C.. Both senators and representatives are chosen through direct election, though vacancies in the Senate may be filled by a gubernatorial appointment. Congress has 535 voting members: 100 senators; the House of Representatives has six non-voting members representing Puerto Rico, American Samoa, the Northern Mariana Islands, the U. S. Virgin Islands, the District of Columbia in addition to its 435 voting members. Although they cannot vote in the full house, these members can address the house and vote in congressional committees, introduce legislation; the members of the House of Representatives serve two-year terms representing the people of a single constituency, known as a "district". Congressional districts are apportioned to states by population using the United States Census results, provided that each state has at least one congressional representative.
Each state, regardless of population or size, has two senators. There are 100 senators representing the 50 states; each senator is elected at-large in their state for a six-year term, with terms staggered, so every two years one-third of the Senate is up for election. To be eligible for election, a candidate must be aged at least 25 or 30, have been a citizen of the United States for seven or nine years, be an inhabitant of the state which they represent; the Congress was created by the Constitution of the United States and first met in 1789, replacing in its legislative function the Congress of the Confederation. Although not mandated, in practice since the 19th century, Congress members are affiliated with the Republican Party or with the Democratic Party and only with a third party or independents. Article One of the United States Constitution states, "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives."
The House and Senate are equal partners in the legislative process—legislation cannot be enacted without the consent of both chambers. However, the Constitution grants each chamber some unique powers; the Senate ratifies treaties and approves presidential appointments while the House initiates revenue-raising bills. The House initiates impeachment cases. A two-thirds vote of the Senate is required before an impeached person can be forcibly removed from office; the term Congress can refer to a particular meeting of the legislature. A Congress covers two years; the Congress ends on the third day of January of every odd-numbered year. Members of the Senate are referred to as senators. Scholar and representative Lee H. Hamilton asserted that the "historic mission of Congress has been to maintain freedom" and insisted it was a "driving force in American government" and a "remarkably resilient institution". Congress is the "heart and soul of our democracy", according to this view though legislators achieve the prestige or name recognition of presidents or Supreme Court justices.
One analyst argues that it is not a reactive institution but has played an active role in shaping government policy and is extraordinarily sensitive to public pressure. Several academics described Congress: Congress reflects us in all our strengths and all our weaknesses, it reflects our regional idiosyncrasies, our ethnic and racial diversity, our multitude of professions, our shadings of opinion on everything from the value of war to the war over values. Congress is the government's most representative body... Congress is charged with reconciling our many points of view on the great public policy issues of the day. Congress is changing and is in flux. In recent times, the American south and west have gained House seats according to demographic changes recorded by the census and includes more minorities and women although both groups are still underrepresented. While power balances among the different parts of government continue to change, the internal structure of Congress is important to understand along with its interactions with so-called intermediary institutions such as political parties, civic associations, interest groups, the mass media.
The Congress of the United States serves two distinct purposes that overlap: local representation to the federal government of a congressional district by representatives and a state's at-large representation to the federal government by senators. Most incumbents seek re-election, their historical likelihood of winning subsequent elections exceeds 90 percent; the historical records of the House of Representatives and the Senate are maintained by the Center for Legislative Archives, a part of the National Archives and Records Administration. Congress is directly responsible for the governing of the District of Columbia, the current seat of the federal government; the First Continental Congress was a gathering of representatives from twelve of the thirteen British Colonies in North America. On July 4, 1776, the Second Continental Congress adopted the Declaration of Independence, referring to the new nation as the "United States of America"; the Articles of Confederation in 1781 created the Congress of the Confederation, a
Benjamin Harrison was an American politician and lawyer who served as the 23rd president of the United States from 1889 to 1893. He was a grandson of the ninth president, William Henry Harrison, creating the only grandfather–grandson duo to have held the office, he was a great-grandson of Benjamin Harrison V, a founding father. Before ascending to the presidency, Harrison had established himself as a prominent local attorney, Presbyterian church leader, politician in Indianapolis, Indiana. During the American Civil War, he served in the Union Army as a colonel, was confirmed by the U. S. Senate as a brevet brigadier general of volunteers in 1865. Harrison unsuccessfully ran for governor of Indiana in 1876; the Indiana General Assembly elected Harrison to a six-year term in the U. S. Senate, where he served from 1881 to 1887. A Republican, Harrison was elected to the presidency in 1888, defeating the Democratic incumbent, Grover Cleveland. Hallmarks of Harrison's administration included unprecedented economic legislation, including the McKinley Tariff, which imposed historic protective trade rates, the Sherman Antitrust Act.
Harrison facilitated the creation of the national forest reserves through an amendment to the Land Revision Act of 1891. During his administration six western states were admitted to the Union. In addition, Harrison strengthened and modernized the U. S. Navy and conducted an active foreign policy, but his proposals to secure federal education funding as well as voting rights enforcement for African Americans were unsuccessful. Due in large part to surplus revenues from the tariffs, federal spending reached one billion dollars for the first time during his term; the spending issue in part led to the defeat of the Republicans in the 1890 mid-term elections. Cleveland defeated Harrison for re-election in 1892, due to the growing unpopularity of the high tariff and high federal spending. Harrison returned to his law practice in Indianapolis. In 1899 Harrison represented the Republic of Venezuela in their British Guiana boundary dispute against the United Kingdom. Harrison traveled to the court of Paris as part of the case and after a brief stay returned to Indianapolis.
He died at his home in Indianapolis in 1901 of complications from influenza. Although many have praised Harrison's commitment to African Americans' voting rights and historians regard his administration as below-average, rank him in the bottom half among U. S. presidents. Historians, have not questioned Harrison's commitment to personal and official integrity. Benjamin Harrison was born on August 20, 1833, in North Bend, the second of Elizabeth Ramsey and John Scott Harrison's ten children, his paternal ancestors were the Harrison family of Virginia, whose immigrant ancestor, Benjamin Harrison I, arrived in Jamestown, circa 1630 from England. Harrison was of English ancestry, all of his ancestors having emigrated to America during the early colonial period; the future President was a grandson of U. S. President William Henry Harrison and a great-grandson of Benjamin Harrison V, a Virginia planter who signed the Declaration of Independence and succeeded Thomas Jefferson as governor of Virginia.
Harrison was seven years old when his grandfather was elected U. S. president, but he did not attend the inauguration. Although Harrison's family was distinguished, his parents were not wealthy. John Scott Harrison, a two-term U. S. congressman from Ohio, spent much of his farm income on his children's education. Despite the family's modest resources, Harrison's boyhood was enjoyable, much of it spent outdoors fishing or hunting. Benjamin Harrison's early schooling took place in a log cabin near his home, but his parents arranged for a tutor to help him with college preparatory studies. Fourteen-year-old Harrison and his older brother, enrolled in Farmer's College near Cincinnati, Ohio, in 1847, he attended the college for two years and while there met his future wife, Caroline "Carrie" Lavinia Scott, a daughter of John Witherspoon Scott, the school's science professor, a Presbyterian minister. In 1850, Harrison transferred to Miami University in Oxford and graduated in 1852, he joined the Phi Delta Theta fraternity.
He was a member of Delta Chi, a law fraternity which permitted dual membership. Classmates included John Alexander Anderson, who became a six-term U. S. congressman, Whitelaw Reid, Harrison's vice presidential running mate in 1892. At Miami, Harrison was influenced by history and political economy professor Robert Hamilton Bishop. Harrison joined a Presbyterian church at college and, like his mother, became a lifelong Presbyterian. After his college graduation in 1852, Harrison studied law with Judge Bellamy Storer of Cincinnati, but before he completed his studies, he returned to Oxford, Ohio, to marry Caroline Scott on October 20, 1853. Caroline's father, a Presbyterian minister, performed the ceremony; the Harrisons had Russell Benjamin Harrison and Mary "Mamie" Scott Harrison. Harrison and his wife returned to live at The Point, his father's farm in southwestern Ohio, while he finished his law studies. Harrison was admitted to the Ohio bar in early 1854, the same year he sold property that he had inherited after the death of an aunt for $800, used the funds to move with Caroline to Indianapolis, Indiana.
Harrison began practicing law in the office of John H. Ray in 1854 and became a crier for the federal court in Indianapolis, for which he was paid $2.50 per day. He served as a Commissioner for the U. S. Court of Claims. Harrison bec
United States Code
The Code of Laws of the United States of America is the official compilation and codification of the general and permanent federal statutes of the United States. It contains 53 titles; the main edition is published every six years by the Office of the Law Revision Counsel of the House of Representatives, cumulative supplements are published annually. The official version of those laws not codified in the United States Code can be found in United States Statutes at Large; the official text of an Act of Congress is that of the "enrolled bill" presented to the President for his signature or disapproval. Upon enactment of a law, the original bill is delivered to the Office of the Federal Register within the National Archives and Records Administration. After authorization from the OFR, copies are distributed as "slip laws" by the Government Printing Office; the Archivist assembles annual volumes of the enacted laws and publishes them as the United States Statutes at Large. By law, the text of the Statutes at Large is "legal evidence" of the laws enacted by Congress.
Slip laws are competent evidence. The Statutes at Large, however, is not a convenient tool for legal research, it is arranged in chronological order so that statutes addressing related topics may be scattered across many volumes. Statutes repeal or amend earlier laws, extensive cross-referencing is required to determine what laws are in force at any given time; the United States Code is the result of an effort to make finding relevant and effective statutes simpler by reorganizing them by subject matter, eliminating expired and amended sections. The Code is maintained by the Office of the Law Revision Counsel of the U. S. House of Representatives; the LRC determines which statutes in the United States Statutes at Large should be codified, which existing statutes are affected by amendments or repeals, or have expired by their own terms. The LRC updates the Code accordingly; because of this codification approach, a single named statute may or may not appear in a single place in the Code. Complex legislation bundles a series of provisions together as a means of addressing a social or governmental problem.
For example, an Act providing relief for family farms might affect items in Title 7, Title 26, Title 43. When the Act is codified, its various provisions might well be placed in different parts of those various Titles. Traces of this process are found in the Notes accompanying the "lead section" associated with the popular name, in cross-reference tables that identify Code sections corresponding to particular Acts of Congress; the individual sections of a statute are incorporated into the Code as enacted. Though authorized by statute, these changes do not constitute positive law; the authority for the material in the United States Code comes from its enactment through the legislative process and not from its presentation in the Code. For example, the United States Code omitted 12 U. S. C. § 92 for decades because it was thought to have been repealed. In its 1993 ruling in U. S. National Bank of Oregon v. Independent Insurance Agents of America, the Supreme Court ruled that § 92 was still valid law.
By law, those titles of the United States Code that have not been enacted into positive law are "prima facie evidence" of the law in effect. The United States Statutes at Large remains the ultimate authority. If a dispute arises as to the accuracy or completeness of the codification of an unenacted title, the courts will turn to the language in the United States Statutes at Large. In case of a conflict between the text of the Statutes at Large and the text of a provision of the United States Code that has not been enacted as positive law, the text of the Statutes at Large takes precedence. In contrast, if Congress enacts a particular title of the Code into positive law, the enactment repeals all of the previous Acts of Congress from which that title of the Code derives; this process makes that title of the United States Code "legal evidence" of the law in force. Where a title has been enacted into positive law, a court may neither permit nor require proof of the underlying original Acts of Congress.
The distinction between enacted and unenacted titles is academic because the Code is nearly always accurate. The United States Code is cited by the Supreme Court and other federal courts without mentioning this theoretical caveat. On a day-to-day basis few lawyers cross-reference the Code to the Statutes at Large. Attempting to capitalize on the possibility that the text of the United States Code can differ from the United States Statutes at Large, Bancroft-Whitney for many years published a series of volumes known as United States Code Service, which used the actual text of the United States Statutes at Large. William McKinley was the 25th president of the United States, serving from March 4, 1897, until his assassination six months into his second term. During his presidency, McKinley led the nation to victory in the Spanish–American War, raised protective tariffs to promote American industry and kept the nation on the gold standard in a rejection of free silver. McKinley was the last president to have served in the American Civil War and the only one to have started the war as an enlisted soldier, beginning as a private in the Union Army and ending as a brevet major. After the war, he settled in Canton, where he practiced law and married Ida Saxton. In 1876, he was elected to Congress, where he became the Republican Party's expert on the protective tariff, which he promised would bring prosperity, his 1890 McKinley Tariff was controversial, which together with a Democratic redistricting aimed at gerrymandering him out of office led to his defeat in the Democratic landslide of 1890. He was elected governor of Ohio in 1891 and 1893, steering a moderate course between capital and labor interests.
With the aid of his close adviser Mark Hanna, he secured the Republican nomination for president in 1896 amid a deep economic depression. He defeated his Democratic rival William Jennings Bryan after a front porch campaign in which he advocated "sound money" and promised that high tariffs would restore prosperity. Rapid economic growth marked McKinley's presidency, he promoted the 1897 Dingley Tariff to protect manufacturers and factory workers from foreign competition and in 1900 secured the passage of the Gold Standard Act. McKinley hoped to persuade Spain to grant independence to rebellious Cuba without conflict, but when negotiation failed he led the nation into the Spanish-American War of 1898; the United States victory was decisive. As part of the peace settlement, Spain turned over to the United States its main overseas colonies of Puerto Rico and the Philippines while Cuba was promised independence, but at that time remained under the control of the United States Army; the United States annexed the independent Republic of Hawaii in 1898 and it became a United States territory.
Historians regard McKinley's 1896 victory as a realigning election in which the political stalemate of the post-Civil War era gave way to the Republican-dominated Fourth Party System, which began with the Progressive Era. McKinley defeated Bryan again in the 1900 presidential election in a campaign focused on imperialism and free silver, his legacy was cut short when he was shot on September 6, 1901 by Leon Czolgosz, a second-generation Polish-American with anarchist leanings. McKinley died eight days and was succeeded by his Vice President Theodore Roosevelt; as an innovator of American interventionism and pro-business sentiment, McKinley's presidency is considered above average, though his positive public perception was soon overshadowed by Roosevelt. William McKinley Jr. was born in 1843 in Niles, the seventh of nine children of William McKinley Sr. and Nancy McKinley. The McKinleys were of English and Scots-Irish descent and had settled in western Pennsylvania in the 18th century, tracing back to a David McKinley, born in Dervock, County Antrim, in present-day Northern Ireland.
There, the elder McKinley was born in Mercer County. The family moved to Ohio, he married her later. The Allison family was of English descent and among Pennsylvania's earliest settlers; the family trade on both sides was iron-making, McKinley senior operated foundries throughout Ohio, in New Lisbon, Niles and Canton. The McKinley household was, like many from Ohio's Western Reserve, steeped in Whiggish and abolitionist sentiment, the latter based on the family's staunch Methodist beliefs. William followed in the Methodist tradition, becoming active in the local Methodist church at the age of sixteen, he was a lifelong pious Methodist. In 1852, the family moved from Niles to Poland, Ohio so that their children could attend the better schools there. Graduating from Poland Seminary in 1859, he enrolled the following year at Allegheny College in Meadville, Pennsylvania, he was an honorary member of the Sigma Alpha Epsilon fraternity. He remained at Allegheny for only one year, returning home in 1860 after becoming depressed.
He spent time at Mount Union College in Alliance, Ohio as a board member. Although his health recovered, family finances declined and McKinley was unable to return to Allegheny, first working as a postal clerk and taking a job teaching at a school near Poland, Ohio; when the Southern states seceded from the Union and the American Civil War began, thousands of men in Ohio volunteered for service. Among them were McKinley and his cousin William McKinley Osbourne, who enlisted as privates in the newly formed Poland Guards in June 1861; the men left for Columbus where they were consolidated with other small units to form the 23rd Ohio Infantry. The men were unhappy to learn that, unlike Ohio's earlier volunteer regiments, they would not be permitted to elect their officers. Dennison appointed Colonel William Rosecrans as the commander of the regiment, the men began training on the outskirts of Columbus. McKinley took to the soldier's life and wrote a series of letters to his hometown newspaper extolling the army and the Union cause.

United States National Forest
National Forest is a classification of protected and managed federal lands in the United States. National Forests are forest and woodland areas owned collectively by the American people through the federal government, managed by the United States Forest Service, a division of the United States Department of Agriculture; the National Forest System was created by the Land Revision Act of 1891, signed under the presidency of Benjamin Harrison. It was the result of concerted action by Los Angeles-area businessmen and property owners who were concerned by the harm being done to the watershed of the San Gabriel Mountains by ranchers and miners. Abbot Kinney and forester Theodore Lukens were key spokesmen for the effort. In the United States there are 155 National Forests containing 190 million acres of land; these lands comprise 8.5 percent of the total land area of the United States, an area about the size of Texas. Some 87 percent of National Forest land lies west of the Mississippi River in the mountain ranges of the Western United States.
Alaska has 12 percent of all National Forest lands. The U. S. Forest Service manages all of the United States National Grasslands, around half of the United States National Recreation Areas. There are two distinctly different types of forests within the National Forest system; those east of the Great Plains in the Midwestern and Eastern United States were acquired by the federal government since 1891, may be second growth forests. The land had long been in the private domain and sometimes logged since colonial times, but was purchased by the United States government in order to create new National Forests; those west of the Great Plains in the Western United States, though established since 1891, are on lands with ownership maintained by the federal government since the U. S. acquisition and settling of the American West. These are lands that were kept in the public domain, with the exception of inholdings and donated or exchanged private forest lands. Land management of these areas focuses on conservation, timber harvesting, livestock grazing, watershed protection and recreation.
Unlike national parks and other federal lands managed by the National Park Service, extraction of natural resources from national forests is permitted, in many cases encouraged. However, the first-designated wilderness areas, some of the largest, are on National Forest lands. There are management decision conflicts between conservationists and environmentalists, natural resource extraction companies and lobbies, over the protection and/or use of National Forest lands; these conflicts center on endangered species protection, logging of old-growth forests, intensive clear cut logging, undervalued stumpage fees, mining operations and mining claim laws, logging/mining access road-building within National Forests. Additional conflicts arise from concerns that the grasslands and forest understory are grazed by sheep, and, more rising numbers of elk and mule deer due to loss of predators.
