Germany the Federal Republic of Germany, is a country in Central and Western Europe, lying between the Baltic and North Seas to the north, the Alps to the south. It borders Denmark to the north and the Czech Republic to the east and Switzerland to the south, France to the southwest, Luxembourg and the Netherlands to the west. Germany includes 16 constituent states, covers an area of 357,386 square kilometres, has a temperate seasonal climate. With 83 million inhabitants, it is the second most populous state of Europe after Russia, the most populous state lying in Europe, as well as the most populous member state of the European Union. Germany is a decentralized country, its capital and largest metropolis is Berlin, while Frankfurt serves as its financial capital and has the country's busiest airport. Germany's largest urban area is the Ruhr, with its main centres of Essen; the country's other major cities are Hamburg, Cologne, Stuttgart, Düsseldorf, Dresden, Bremen and Nuremberg. Various Germanic tribes have inhabited the northern parts of modern Germany since classical antiquity.
A region named Germania was documented before 100 AD. During the Migration Period, the Germanic tribes expanded southward. Beginning in the 10th century, German territories formed a central part of the Holy Roman Empire. During the 16th century, northern German regions became the centre of the Protestant Reformation. After the collapse of the Holy Roman Empire, the German Confederation was formed in 1815; the German revolutions of 1848–49 resulted in the Frankfurt Parliament establishing major democratic rights. In 1871, Germany became a nation state when most of the German states unified into the Prussian-dominated German Empire. After World War I and the revolution of 1918–19, the Empire was replaced by the parliamentary Weimar Republic; the Nazi seizure of power in 1933 led to the establishment of a dictatorship, the annexation of Austria, World War II, the Holocaust. After the end of World War II in Europe and a period of Allied occupation, Austria was re-established as an independent country and two new German states were founded: West Germany, formed from the American and French occupation zones, East Germany, formed from the Soviet occupation zone.
Following the Revolutions of 1989 that ended communist rule in Central and Eastern Europe, the country was reunified on 3 October 1990. Today, the sovereign state of Germany is a federal parliamentary republic led by a chancellor, it is a great power with a strong economy. As a global leader in several industrial and technological sectors, it is both the world's third-largest exporter and importer of goods; as a developed country with a high standard of living, it upholds a social security and universal health care system, environmental protection, a tuition-free university education. The Federal Republic of Germany was a founding member of the European Economic Community in 1957 and the European Union in 1993, it is part of the Schengen Area and became a co-founder of the Eurozone in 1999. Germany is a member of the United Nations, NATO, the G7, the G20, the OECD. Known for its rich cultural history, Germany has been continuously the home of influential and successful artists, musicians, film people, entrepreneurs, scientists and inventors.
Germany has a large number of World Heritage sites and is among the top tourism destinations in the world. The English word Germany derives from the Latin Germania, which came into use after Julius Caesar adopted it for the peoples east of the Rhine; the German term Deutschland diutisciu land is derived from deutsch, descended from Old High German diutisc "popular" used to distinguish the language of the common people from Latin and its Romance descendants. This in turn descends from Proto-Germanic *þiudiskaz "popular", derived from *þeudō, descended from Proto-Indo-European *tewtéh₂- "people", from which the word Teutons originates; the discovery of the Mauer 1 mandible shows that ancient humans were present in Germany at least 600,000 years ago. The oldest complete hunting weapons found anywhere in the world were discovered in a coal mine in Schöningen between 1994 and 1998 where eight 380,000-year-old wooden javelins of 1.82 to 2.25 m length were unearthed. The Neander Valley was the location where the first non-modern human fossil was discovered.

Folklore is the expressive body of culture shared by a particular group of people. These include oral traditions such as tales and jokes, they include material culture, ranging from traditional building styles to handmade toys common to the group. Folklore includes customary lore, the forms and rituals of celebrations such as Christmas and weddings, folk dances and initiation rites; each one of these, either singly or in combination, is considered a folklore artifact. Just as essential as the form, folklore encompasses the transmission of these artifacts from one region to another or from one generation to the next. Folklore is not something one can gain in a formal school curriculum or study in the fine arts. Instead, these traditions are passed along informally from one individual to another either through verbal instruction or demonstration; the academic study of folklore is called Folklore studies, it can be explored at undergraduate, graduate and Ph. D. levels. To understand folklore, it is helpful to clarify its component parts: the terms folk and lore.
It is well-documented. He fabricated it to replace the contemporary terminology of "popular antiquities" or "popular literature"; the second half of the compound word, proves easier to define as its meaning has stayed stable over the last two centuries. Coming from Old English lār'instruction,' and with German and Dutch cognates, it is the knowledge and traditions of a particular group passed along by word of mouth; the concept of folk proves somewhat more elusive. When Thoms first created this term, folk applied only to rural poor and illiterate peasants. A more modern definition of folk is a social group which includes two or more persons with common traits, who express their shared identity through distinctive traditions. "Folk is a flexible concept which can refer to a nation as in American folklore or to a single family." This expanded social definition of folk supports a broader view of the material, i.e. the lore, considered to be folklore artifacts. These now include all "things people make with words, things they make with their hands, things they make with their actions".
Folklore is no longer circumscribed as being chronologically obsolete. The folklorist studies the traditional artifacts of a social group. Transmission is a vital part of the folklore process. Without communicating these beliefs and customs within the group over space and time, they would become cultural shards relegated to cultural archaeologists. For folklore is a verb; these folk artifacts continue to be passed along informally, as a rule anonymously and always in multiple variants. The folk group is not individualistic, it nurtures its lore in community. "As new groups emerge, new folklore is created… surfers, computer programmers". In direct contrast to high culture, where any single work of a named artist is protected by copyright law, folklore is a function of shared identity within the social group. Having identified folk artifacts, the professional folklorist strives to understand the significance of these beliefs and objects for the group. For these cultural units would not be passed along unless they had some continued relevance within the group.
That meaning can however morph. So Halloween of the 21st century is not the All Hallows' Eve of the Middle Ages, gives rise to its own set of urban legends independent of the historical celebration; the cleansing rituals of Orthodox Judaism were good public health in a land with little water. Compare this to brushing your teeth transmitted within a group, which remains a practical hygiene and health issue and does not rise to the level of a group-defining tradition. For tradition is remembered behavior. Once it loses its practical purpose, there is no reason for further transmission unless it has been imbued with meaning beyond the initial practicality of the action; this meaning is at the core of the study of folklore. With an theoretical sophistication of the social sciences, it has become evident that folklore is a occurring and necessary component of any social group, it is indeed all around us, it does not have to be antiquated. It continues to be created, transmitted and in any group is used to differentiate between "us" and "them".
Folklore began to distinguish itself as an autonomous discipline during the period of romantic nationalism in Europe. A particular figure in this development was Johann Gottfried von Herder, whose writings in the 1770s presented oral traditions as organic processes grounded in locale. After the German states were invaded by Napoleonic France, Herder's approach was adopted by many of his fellow Germans who systematized the recorded folk traditions and used them in their process of nation building; this process was enthusiastically embraced by smaller nations like Finland and Hungary, which were seeking political independence from their dominant neighbours. Folklore as a field of study further developed among 19th century European scholars who were contrasting tradition with the newly developing modernity, its focus was the oral folklore of the rural peasant populations, which were considered as residue and survivals of the past that continued to exist within the lower strata of society. The public domain consists of all the creative works to which no exclusive intellectual property rights apply. Those rights may have been forfeited, expressly waived, or may be inapplicable; the works of William Shakespeare and Beethoven, most early silent films, are in the public domain either by virtue of their having been created before copyright existed, or by their copyright term having expired. Some works are not covered by copyright, are therefore in the public domain—among them the formulae of Newtonian physics, cooking recipes, all computer software created prior to 1974. Other works are dedicated by their authors to the public domain; the term public domain is not applied to situations where the creator of a work retains residual rights, in which case use of the work is referred to as "under license" or "with permission". As rights vary by country and jurisdiction, a work may be subject to rights in one country and be in the public domain in another; some rights depend on registrations on a country-by-country basis, the absence of registration in a particular country, if required, gives rise to public-domain status for a work in that country.
The term public domain may be interchangeably used with other imprecise or undefined terms such as the "public sphere" or "commons", including concepts such as the "commons of the mind", the "intellectual commons", the "information commons". Although the term "domain" did not come into use until the mid-18th century, the concept "can be traced back to the ancient Roman Law, as a preset system included in the property right system." The Romans had a large proprietary rights system where they defined "many things that cannot be owned" as res nullius, res communes, res publicae and res universitatis. The term res nullius was defined as things not yet appropriated; the term res communes was defined as "things that could be enjoyed by mankind, such as air and ocean." The term res publicae referred to things that were shared by all citizens, the term res universitatis meant things that were owned by the municipalities of Rome. When looking at it from a historical perspective, one could say the construction of the idea of "public domain" sprouted from the concepts of res communes, res publicae, res universitatis in early Roman law.
When the first early copyright law was first established in Britain with the Statute of Anne in 1710, public domain did not appear. However, similar concepts were developed by French jurists in the 18th century. Instead of "public domain", they used terms such as publici juris or propriété publique to describe works that were not covered by copyright law; the phrase "fall in the public domain" can be traced to mid-19th century France to describe the end of copyright term. The French poet Alfred de Vigny equated the expiration of copyright with a work falling "into the sink hole of public domain" and if the public domain receives any attention from intellectual property lawyers it is still treated as little more than that, left when intellectual property rights, such as copyright and trademarks, expire or are abandoned. In this historical context Paul Torremans describes copyright as a, "little coral reef of private right jutting up from the ocean of the public domain." Copyright law differs by country, the American legal scholar Pamela Samuelson has described the public domain as being "different sizes at different times in different countries".
Definitions of the boundaries of the public domain in relation to copyright, or intellectual property more regard the public domain as a negative space. According to James Boyle this definition underlines common usage of the term public domain and equates the public domain to public property and works in copyright to private property. However, the usage of the term public domain can be more granular, including for example uses of works in copyright permitted by copyright exceptions; such a definition regards work in copyright as private property subject to fair-use rights and limitation on ownership. A conceptual definition comes from Lange, who focused on what the public domain should be: "it should be a place of sanctuary for individual creative expression, a sanctuary conferring affirmative protection against the forces of private appropriation that threatened such expression". Patterson and Lindberg described the public domain not as a "territory", but rather as a concept: "here are certain materials – the air we breathe, rain, life, thoughts, ideas, numbers – not subject to private ownership.

Washington Irving was an American short story writer, biographer and diplomat of the early 19th century. He is best known for his short stories "Rip Van Winkle" and "The Legend of Sleepy Hollow", both of which appear in his collection The Sketch Book of Geoffrey Crayon, Gent, his historical works include biographies of Oliver Goldsmith, Islamic prophet Muhammad, George Washington, as well as several histories of 15th century Spain that deal with subjects such as Alhambra, Christopher Columbus, the Moors. Irving served as ambassador to Spain from 1842 to 1846, he made his literary debut in 1802 with a series of observational letters to the Morning Chronicle, written under the pseudonym Jonathan Oldstyle. He moved to England for the family business in 1815 where he achieved fame with the publication of The Sketch Book of Geoffrey Crayon, Gent. serialized from 1819–20. He continued to publish throughout his life, he completed a five-volume biography of George Washington just eight months before his death at age 76 in Tarrytown, New York.
Irving was one of the first American writers to earn acclaim in Europe, he encouraged other American authors such as Nathaniel Hawthorne, Henry Wadsworth Longfellow, Herman Melville, Edgar Allan Poe. He was admired by some British writers, including Lord Byron, Thomas Campbell, Charles Dickens, Francis Jeffrey, Walter Scott, he advocated for writing as a legitimate profession and argued for stronger laws to protect American writers from copyright infringement. Washington Irving's parents were William Irving Sr. of Quholm, Orkney and Sarah of Falmouth, England. They married in 1761, they had eleven children. Their first two sons died in infancy, both named William, as did their fourth child John, their surviving children were William Jr. Ann, Catherine, John Treat and Washington; the Irving family settled in Manhattan and were part of the city's merchant class when Washington was born on April 3, 1783, the same week that New York City residents learned of the British ceasefire which ended the American Revolution, Irving's mother named him after George Washington.
Irving met his namesake at age 6, when George Washington was living in New York after his inauguration as President in 1789. The President blessed young Irving, an encounter that Irving commemorated in a small watercolor painting which continues to hang in his home; the Irvings lived at 131 William Street at the time of Washington's birth, but they moved across the street to 128 William St. Several of Irving's brothers became active New York merchants. Irving was an uninterested student who preferred adventure stories and drama, he sneaked out of class in the evenings to attend the theater by the time he was 14. An outbreak of yellow fever in Manhattan in 1798 prompted his family to send him upriver, he stayed with his friend James Kirke Paulding in Tarrytown, New York, it was in Tarrytown that he became familiar with the nearby town of Sleepy Hollow, New York, with its Dutch customs and local ghost stories. He made several other trips up the Hudson as a teenager, including an extended visit to Johnstown, New York where he passed through the Catskill Mountains region, the setting for "Rip Van Winkle".
"Of all the scenery of the Hudson", Irving wrote, "the Kaatskill Mountains had the most witching effect on my boyish imagination". Irving began writing letters to the New York Morning Chronicle in 1802 when he was 19, submitting commentaries on the city's social and theater scene under the pseudonym Jonathan Oldstyle; the name evoked his Federalist leanings and was the first of many pseudonyms that he employed throughout his career. The letters brought Irving moderate notoriety. Aaron Burr was a co-publisher of the Chronicle, he was impressed enough to send clippings of the Oldstyle pieces to his daughter Theodosia. Charles Brockden Brown made a trip to New York to recruit Oldstyle for a literary magazine that he was editing in Philadelphia. Irving's brothers became concerned for his health, so they financed an extended tour of Europe from 1804 to 1806, he bypassed most of the sites and locations considered essential for the social development of a young man, to the dismay of his brother William who wrote that he was pleased that his brother's health was improving, but he did not like the choice to "gallop through Italy… leaving Florence on your left and Venice on your right".
Instead, Irving honed the social and conversational skills that made him one of the world's most in-demand guests. "I endeavor to take things as they come with cheerfulness", Irving wrote, "and when I cannot get a dinner to suit my taste, I endeavor to get a taste to suit my dinner". While visiting Rome in 1805, Irving struck up a friendship with painter Washington Allston and was persuaded into a career as a painter. "My lot in life, was differently cast". Irving returned from Europe to study law with his legal mentor Judge Josiah Ogden Hoffman in New York City. By his own admission, he was not a good student and passed the bar examination in 1806, he began socializing with a group of literate young men whom he dubbed "The Lads of Kilkenny", he created the literary magazine Salmagundi in January 1807 with his brother William and his friend James Kirke Paulding, writing under various pseudonyms, such as William Wizard and Launcelot Langstaff. "Rip Van Winkle" is a short story by the American author Washington Irving, first published in 1819. It follows a Dutch-American villager in colonial America named Rip Van Winkle who falls asleep in the Catskill Mountains and wakes up 20 years having missed the American Revolution. Irving wrote it while living in Birmingham, England, as part of the collection The Sketch Book of Geoffrey Crayon, Gent; the story is set in New York's Catskill Mountains, but Irving admitted, "When I wrote the story, I had never been on the Catskills." "Rip Van Winkle" is set in the years before and after the American Revolutionary War in a village at the foot of New York's Catskill Mountains where Rip Van Winkle, a Dutch-American villager, lives. One autumn day, Van Winkle wanders into the mountains with his dog Wolf to escape his wife's nagging, he hears his name sees a man wearing antiquated Dutch clothing. Together, the men and Wolf proceed to a hollow in which Rip discovers the source of thunderous noises: a group of ornately dressed, bearded men who are playing nine-pins.
Van Winkle does not ask how they know his name. Instead, he soon falls asleep; when he awakens on the mountain, he discovers shocking changes: his musket is rotting and rusty, his beard is a foot long, his dog is nowhere to be found. He returns to his village, he arrives just after an election, people ask how he voted. Never having cast a ballot in his life, he proclaims himself a faithful subject of King George III, unaware that the American Revolution has taken place, nearly gets himself into trouble with the townspeople until one elderly woman recognizes him as the long-lost Rip Van Winkle. King George's portrait on the inn's sign has been replaced with one of George Washington. Van Winkle learns, he is disturbed to find another man called Rip Van Winkle. Van Winkle discovers that his wife died some time ago but is not saddened by the news, he learns that the men whom he met in the mountains are rumored to be the ghosts of Henry Hudson's crew from his ship, the Halve Maen. He realizes that he has been away from the village for at least 20 years.
His grown daughter takes him in and he resumes his usual idleness. His strange tale is solemnly taken to heart by the Dutch settlers by the children who say that, whenever thunder is heard, the men in the mountains must be playing nine-pins. After a failed business venture with his brothers, Irving filed for bankruptcy in 1818. Despondent, he turned to writing for possible financial support, although he had difficulty thinking of stories to write, he stayed in England with his brother-in-law Henry Van Wart. The two were reminiscing in June 1818 when Irving was inspired by their nostalgic conversation. Irving wrote non-stop all night; as he said, he felt like a man waking from a long sleep. He presented the first draft of "Rip Van Winkle" to the Van Wart family over breakfast."Rip Van Winkle" was one of the first stories Irving proposed for his new book, The Sketch Book of Geoffrey Crayon, Gent. Irving asked his brother Ebeneezer to assist with publication in the United States; as Irving wrote, "I shall feel anxious to hear of the success of this first re-appearance on the literary stage – Should it be successful, I trust I shall be able henceforth to keep up an occasional fire."
2,000 copies of the first octavo-sized installment, which included "Rip Van Winkle", were released on June 23, 1819, in Baltimore, New York, Philadelphia, published by Cornelius S. Van Winkle, sold at a somewhat expensive 75 cents. A British edition was published shortly afterward, by John Miller, who went out of business thereafter. With help from his friend Walter Scott, Irving was able to convince John Murray to take over British publication of the Sketch Book. Following the success of Rip Van Winkle in print and on stage celebrated editions were illustrated by Arthur Rackham and N. C. Wyeth. In the tenth chapter of his book Lives and Opinions of Eminent Philosophers, the third-century AD Greek historian Diogenes Laërtius relates the story of the legendary sage Epimenides of Knossos, said to have been a shepherd on the island of Krete. One day, Epimenides followed after a sheep that had wandered off and, after becoming tired, went into a cave under Mount Ida and fell asleep; when he awoke, he continued searching for the sheep, but could not find it, so he returned to his father's farm, only to discover that it was under new ownership.
He went home. He encountered his younger brother, who had become an old man, learned that he had been asleep in the cave for fifty-seven years. According to the different sources that Diogenes relates, Epimenides lived to be 154, 157, or 299 years old. Multiple sources have identified the story of Epimenides as the earliest known variant of the "Rip Van Winkle" fairy tale. In Christian tradition, there is a similar, well-known story of "The Seven Sleepers of Ephesus", which recounts a group of early Christians who hid in a cave circa 250 AD, to escape the persecution of Christians during the reign of the Roman emperor Decius, they fell into a miraculous sleep and woke some 200 years during the reign of Theodosius II, to discover that the city and the whole Empire had become Christian.
