California State Assembly
The California State Assembly is the lower house of the California State Legislature, the upper house being the California State Senate. The Assembly convenes, along with the State Senate, at the California State Capitol in Sacramento; the Assembly consists with each member representing at least 465,000 people. Due to a combination of the state's large population and small legislature, the Assembly has the largest population-per-representative ratio of any state lower house and second largest of any legislative lower house in the United States after the federal House of Representatives. Members of the California State Assembly are referred to using the titles Assemblyman, Assemblywoman, or Assemblymember. In the current legislative session, Democrats enjoy a three-fourths supermajority of 61 seats, while Republicans controls 19 seats; the Speaker presides over the State Assembly in the chief leadership position, controlling the flow of legislation and committee assignments. The Speaker is elected by the full Assembly.
Other leaders, such as the majority and minority leaders, are elected by their respective party caucuses according to each party's strength in the chamber. The current Speaker is Democrat Anthony Rendon; the majority leader is Democrat Ian Calderon. As a result of Proposition 140 in 1990 and Proposition 28 in 2012, members elected to the Legislature prior to 2012 are restricted by term limits to three two-year terms, while those elected in or after 2012 are allowed to serve 12 years in the legislature in any combination of four-year State Senate or two-year State Assembly terms; every two years, all 80 seats in the Assembly are subject to election. This is in contrast to the State Senate, in which only half of its 40 seats are subject to election every two years; the chamber's green tones are based on the House of Commons of the United Kingdom. The dais rests along a wall shaped like an "E", with its central projection housing the rostrum. Along the cornice appears a portrait of Abraham Lincoln and a Latin quotation: legislatorum est justas leges condere.
Every decorating element is identical to the Senate Chamber. To run for the Assembly, a candidate must be a United States citizen and a registered voter in the district at the time nomination papers are issued, may not have served three terms in the State Assembly since November 6, 1990. According to Article 4, Section 2 of the California Constitution, the candidate must have one year of residency in the legislative district and California residency for three years; the chief clerk of the Assembly, a position that has existed since the Assembly's creation, is responsible for many administrative duties. The chief clerk is the custodian of all Assembly bills and records and publishes the Assembly Daily Journal, the minutes of floor sessions, as well as the Assembly Daily File; the chief clerk is the Assembly's parliamentarian, in this capacity gives advice to the presiding officer on matters of parliamentary procedure. The chief clerk is responsible for engrossing and enrolling of measures, the transmitting passed legislation to the governor.
Since 2016, the chaplain of the Assembly has been a Buddhist cleric. The chaplain from 2003 to 2016 was a Greek Orthodox priest; the position of sergeant-at-arms of the Assembly has existed since 1849. The sergeant-at-arms is tasked with law enforcement duties, but customarily has a ceremonial and protocol role. Today, some fifty employees are part of the Assembly Sergeant-at-Arms Office; the Chief Clerk, the acting Chief Sergeant-at-Arms, the Chaplains are not members of the Legislature. A legislature is a deliberative assembly with the authority to make laws for a political entity such as a country or city. Legislatures form important parts of most governments. Laws enacted by legislatures are known as primary legislation. Legislatures observe and steer governing actions and have exclusive authority to amend the budget or budgets involved in the process; the members of a legislature are called legislators. In a democracy, legislators are most popularly elected, although indirect election and appointment by the executive are used for bicameral legislatures featuring an upper chamber. Names for national legislatures include "parliament", "congress", "diet", "assembly", depending on country; each chamber of the legislature consists of a number of legislators who use some form of parliamentary procedure to debate political issues and vote on proposed legislation. There must be a certain number of legislators present to carry out these activities; some of the responsibilities of a legislature, such as giving first consideration to newly proposed legislation, are delegated to committees made up of a few of the members of the chamber.
The members of a legislature represent different political parties. Legislatures vary in the amount of political power they wield, compared to other political players such as judiciaries and executives. In 2009, political scientists M. Steven Fish and Matthew Kroenig constructed a Parliamentary Powers Index in an attempt to quantify the different degrees of power among national legislatures; the German Bundestag, the Italian Parliament, the Mongolian State Great Khural tied for most powerful, while Myanmar's House of Representatives and Somalia's Transitional Federal Assembly tied for least powerful. Some political systems follow the principle of legislative supremacy, which holds that the legislature is the supreme branch of government and cannot be bound by other institutions, such as the judicial branch or a written constitution; such a system renders the legislature more powerful. In parliamentary and semi-presidential systems of government, the executive is responsible to the legislature, which may remove it with a vote of no confidence.
On the other hand, according to the separation of powers doctrine, the legislature in a presidential system is considered an independent and coequal branch of government along with both the judiciary and the executive. Legislatures will sometimes delegate their legislative power to administrative or executive agencies. Legislatures are made up of individual members, known as legislators. A legislature contains a fixed number of legislators. For example, a legislature that has 100 "seats" has 100 members. By extension, an electoral district that elects a single legislator can be described as a "seat", as, example, in the phrases "safe seat" and "marginal seat". A legislature may debate and vote upon bills as a single unit, or it may be composed of multiple separate assemblies, called by various names including legislative chambers, debate chambers, houses, which debate and vote separately and have distinct powers. A legislature which operates as a single unit is unicameral, one divided into two chambers is bicameral, one divided into three chambers is tricameral.
In bicameral legislatures, one chamber is considered the upper house, while the other is considered the lower house. The two types are not rigidly different, but members of upper houses tend to be indirectly elected or appointed rather than directly elected, tend to be allocated by administrative divisions rather than by population, tend to have longer terms than members of the lower house. In some systems parliamentary systems, the upper house has less power and tends to have a more advisory role, but in others presidential systems, the upper house has equal or greater power. In federations, the upper house represents the federation's component states; this is a case with the supranational legislature of the European Union. The upper house may either contain the delegates of state governments – as in the European Union and in Germany and, before 1913, in the United States – or be elected according to a formula that grants equal representation to states with smaller populations, as is the case in Australia and the United States since 1913.
Tricameral legislatures are rare. Tetracameral legislatures no longer exist, but they were used in Scandinavia. Legislatures vary in their size. Among national legislatures, China's National People's Congress is the largest with 2 980 members, while Vatican City's Pontifical Commission is the smallest with 7. Neither legislature is democratically elected: the National People's Congress is indirectly elected. Legislature size is a trade off between representation. Comparative analysis of national legislatures has found that size of a country's lower house tends to be proportional to the cube root of its population.
2016 California State Assembly election
The 2016 California State Assembly election was held on Tuesday, November 8, 2016, with the primary election held on June 7, 2016. Voters in the 80 districts of the California State Assembly elected their representatives; the elections coincided with the elections for other offices, including for U. S. President and the state senate. Benefiting from the large Democratic turnout due to the general election, the California Democratic Party made gains by ousting three Republican incumbents in the 60th, 65th, 66th districts, thus regaining the two-thirds supermajority that they had lost in the previous elections
Marie Waldron is an American politician serving as the minority leader of the California State Assembly. She is a Republican representing the 75th district, encompassing parts of inland northern San Diego and southwestern Riverside counties. Prior to being elected to the state assembly, she was an Escondido city councilmember. On November 8, 2018, she was elected by her Assembly Republican colleagues to serve as Assembly minority leader. Northern California is the northern portion of the U. S. state of California. Spanning the state's northernmost 48 counties its main population centers include the San Francisco Bay Area, the Greater Sacramento area, the Metropolitan Fresno area. Northern California contains redwood forests, along with the Sierra Nevada, including Yosemite Valley and part of Lake Tahoe, Mount Shasta, most of the Central Valley, one of the world's most productive agricultural regions; the 48-county definition is not used for the Northern California Megaregion, one of the 11 megaregions of the United States. The megaregion's area is instead defined from Metropolitan Fresno north to Greater Sacramento, from the Bay Area east across Nevada state line to encompass the entire Lake Tahoe-Reno area. Native Americans arrived in northern California at least as early as 8,000 to 5,000 BC and even much earlier, successive waves of arrivals led to one of the most densely populated areas of pre-Columbian North America; the arrival of European explorers from the early 16th to the mid-18th centuries did not establish European settlements in northern California.
In 1770, the Spanish mission at Monterey was the first European settlement in the area, followed by other missions along the coast—eventually extending as far north as Sonoma County. Northern California is not a formal geographic designation. California's north-south midway division is around 37° latitude, near the level of San Francisco. Popularly, though, "Northern California" refers to the state's northernmost 48 counties; because of California's large size and diverse geography, the state can be subdivided in other ways as well. For example, the Central Valley is a region, distinct both culturally and topographically from coastal California, though in northern versus southern California divisions, the Sacramento Valley and most of the San Joaquin Valley are placed in northern California; the state is considered as having an additional division north of the urban areas of the San Francisco Bay Area and Sacramento metropolitan areas. Extreme northern residents have felt under-represented in state government and in 1941 attempted to form a new state with southwestern Oregon to be called Jefferson, or more to introduce legislation to split California into two or three states.
The coastal area north of the Bay Area is referred to as the North Coast, while the interior region north of Sacramento is referred by locals as the Northstate. Northern California is the name of a proposed new state on the 2018 California ballot created by splitting the existing state into three parts. Since the events of the California Gold Rush, Northern California has been a leader on the world's economic and cultural stages. From the development of gold mining techniques and logging practices in the 19th century that were adopted around the world, to the development of world-famous and online business models, northern California has been at the forefront of new ways of doing business. In science, advances range from being the first to isolate and name fourteen transuranic chemical elements, to breakthroughs in microchip technology. Cultural contributions include the works of Ansel Adams, George Lucas, Clint Eastwood, as well as beatniks, the Summer of Love, the cradle of the international environmental movement, the open, casual workplace first popularized in the Silicon Valley dot-com boom and now in use around the world.
Other examples of innovation across diverse fields range from Genentech to CrossFit as a pioneer in extreme human fitness and training. It is home to one of the largest Air Force Bases on the West Coast, the largest of California, Travis Air Force Base. Northern California's largest metropolitan area is the San Francisco Bay Area which includes the cities of San Francisco, San Jose and their many suburbs. In recent years the Bay Area has drawn more commuters from as far as Central Valley cities such as Sacramento, Fresno and Modesto. With expanding development in all these areas, the San Francisco Bay Area, Monterey Bay Area, central part of the Central Valley and Sierra Nevada foothills may now be viewed as part of a single megalopolis; the 2010 U. S. Census showed that the Bay Area grew at a faster rate than the Greater Los Angeles Area while Greater Sacramento had the largest growth rate of any metropolitan area in California; the state's larger inland cities are considered part of Northern California in cases when the state is divided into two parts.
Important cities in the region not in major metropolitan areas include Eureka on the far North Coast, Redding, at the northern end of the Central Valley and Yuba City in the mid-north of the Valley, as well as Fresno and Visalia on the southern end. Though smaller in every case except for Fresno than the larger cities of the vast region, these smaller regional centers are of historical, inflated economic importance for their respective size, due to their locations, which are rural or otherwise isolated. California Democratic Party
The California Democratic Party is the state branch of the United States Democratic Party in the state of California. The party is headquartered in Sacramento, is led by acting-Chair Alex Gallardo-Rooker. With 43.5% of the state's registered voters as of 2018, the Democratic Party has the highest number of registrants of any political party in California. Democrats enjoy supermajorities in both houses of the California State Legislature, holding 61 out of 80 seats in the California State Assembly and 29 out of 40 in the California State Senate. Democrats hold all 8 statewide executive branch offices, 46 of the state's 53 seats in the House of Representatives, both of California's seats in the United States Senate. Since the beginning of the 1850s, issues regarding slavery had split the California Democratic Party. By the 1853 general election campaign, large majorities of pro-slavery Democrats from Southern California, calling themselves the Chivalry, threatened to divide the state in half, should the state not accept slavery.
John Bigler, along with former State Senator and Lieutenant Governor David C. Broderick from the previous McDougall Administration, formed the Free Soil Democratic faction, modeled after the federal Free Soil Party that argued against the spread of slavery; the Democrats split into two camps, with both the Chivalry and Free Soilers nominating their own candidates for the 1853 election. By 1857, the party had split into the Anti-Lecompton factions. Lecompton members supported the Kansas Lecompton Constitution, a document explicitly allowing slavery into the territory, while Anti-Lecompton faction members were in opposition to slavery's expansion; the violence between supporting and opposition forces led to the period known as Bleeding Kansas. Splits in the Democratic Party, as well as the power vacuum created by the collapse of the Whig Party, helped facilitate the rise of the American Party both in state and federal politics. In particular, state voters voted Know-Nothings into the California State Legislature, elected J. Neely Johnson as governor in the 1855 general elections.
During the 1859 general elections, Lecompton Democrats voted for Milton Latham, who had lived in the American South, as their nominee for Governor. Anti-Lecomptons in turn selected John Currey as their nominee; the infant Republican Party, running in its first gubernatorial election, selected businessman Leland Stanford as its nominee. To make matters more complicated, during the campaign, Senator David C. Broderick, an Anti-Lecompton Democrat, was killed in a duel by slavery supporter and former state Supreme Court Justice David Terry on September 13; until the early 1880s the Republican Party held the state through the power and influence of railroad men. The Democratic Party responded by taking an anti freedom of attainment position. In 1894, Democrat James Budd was elected to the governorship, the Democratic Party attempted to make good on their promises to reform the booming railroad industry; the party began working with the state's railroad commission to create fair rates for passengers and to eliminate monopolies the railroad companies held over the state.
The main effort focused on making railroads public avenues of transportation similar to streets and roads. This measure passed and was a great victory for the Democrats. Budd was to be the last Democratic governor for thirty years; the struggle between the anti-monopolists and the railroad companies was, however, a key and defining issue for the Democratic Party for some time. Despite their relative lack of power during this period, the Democrats in California were still active in pursuing reform; the party crusaded for tariff reform. The party supported the large scale railroad strikes that sprung up statewide; the corruption of the time in both the railroad companies and the government led to a change in political dynamic. The people of the state moved away from both of the main parties and the Progressive Movement began. While the Progressives were successful in creating positive reform and chasing out corruption, the movement drained away many of the Democratic Party's members; as their movement ended, the Republicans won the governorship, but the Democratic Party had a distinct voter advantage.
In 1932, Franklin D. Roosevelt was elected president and the Power balance between the Republicans and the Democrats in California equalized. However, as Roosevelt's New Deal policies began to raise the nation out of the depression, Democratic strength mounted. Culbert Olson was elected to the governorship, but his term was rocky and both parties organized against him. Shortly thereafter, Earl Warren and the Republicans seized power again; the California Democratic Party needed a new strategy to regain power in the state. A strategy of reorganization and popular mobilization emerged and resulted in the creation of the California Democratic Council; the CDC as it became known was a way for members of the party from all levels of government to come together and as such the party became more unified. A new network of politically minded civilians and elected officials emerged and the party was stronger for it. Despite the fact that the council struggled in the cold war era, due to Republican strength and issues such as the Vietnam War, it still exists today.

Law is a system of rules that are created and enforced through social or governmental institutions to regulate behavior. It has been defined both as "the Science of Justice" and "the Art of Justice". Law is a system that regulates and ensures that individuals or a community adhere to the will of the state. State-enforced laws can be made by a collective legislature or by a single legislator, resulting in statutes, by the executive through decrees and regulations, or established by judges through precedent in common law jurisdictions. Private individuals can create binding contracts, including arbitration agreements that may elect to accept alternative arbitration to the normal court process; the formation of laws themselves may be influenced by a constitution, written or tacit, the rights encoded therein. The law shapes politics, economics and society in various ways and serves as a mediator of relations between people. A general distinction can be made between civil law jurisdictions, in which a legislature or other central body codifies and consolidates their laws, common law systems, where judge-made precedent is accepted as binding law.
Religious laws played a significant role in settling of secular matters, is still used in some religious communities. Islamic Sharia law is the world's most used religious law, is used as the primary legal system in some countries, such as Iran and Saudi Arabia; the adjudication of the law is divided into two main areas. Criminal law deals with conduct, considered harmful to social order and in which the guilty party may be imprisoned or fined. Civil law deals with the resolution of lawsuits between individuals and/or organizations. Law provides a source of scholarly inquiry into legal history, economic analysis and sociology. Law raises important and complex issues concerning equality and justice. Numerous definitions of law have been put forward over the centuries; the Third New International Dictionary from Merriam-Webster defines law as: "Law is a binding custom or practice of a community. The Dictionary of the History of Ideas published by Scribner's in 1973 defined the concept of law accordingly as: "A legal system is the most explicit, institutionalized, complex mode of regulating human conduct.
At the same time, it plays only one part in the congeries of rules which influence behavior, for social and moral rules of a less institutionalized kind are of great importance." There have been several attempts to produce "a universally acceptable definition of law". In 1972, one source indicated. McCoubrey and White said that the question "what is law?" has no simple answer. Glanville Williams said that the meaning of the word "law" depends on the context in which that word is used, he said that, for example, "early customary law" and "municipal law" were contexts where the word "law" had two different and irreconcilable meanings. Thurman Arnold said that it is obvious that it is impossible to define the word "law" and that it is equally obvious that the struggle to define that word should not be abandoned, it is possible to take the view that there is no need to define the word "law". The history of law links to the development of civilization. Ancient Egyptian law, dating as far back as 3000 BC, contained a civil code, broken into twelve books.
It was based on the concept of Ma'at, characterised by tradition, rhetorical speech, social equality and impartiality. By the 22nd century BC, the ancient Sumerian ruler Ur-Nammu had formulated the first law code, which consisted of casuistic statements. Around 1760 BC, King Hammurabi further developed Babylonian law, by codifying and inscribing it in stone. Hammurabi placed several copies of his law code throughout the kingdom of Babylon as stelae, for the entire public to see; the most intact copy of these stelae was discovered in the 19th century by British Assyriologists, has since been transliterated and translated into various languages, including English, Italian and French. The Old Testament dates back to 1280 BC and takes the form of moral imperatives as recommendations for a good society; the small Greek city-state, ancient Athens, from about the 8th century BC was the first society to be based on broad inclusion of its citizenry, excluding women and the slave class. However, Athens had no legal science or single word for "law", relying instead on the three-way distinction between divine law, human decree and custom.
Yet Ancient Greek law contained major constitutional innovations in the development of democracy. Roman law was influenced by Greek philosophy, but its detailed rules were developed by professional jurists and were sophisticated. Over the centuries between the rise and decline of the Roman Empire, law was adapted to cope with the changing social situations and underwent major codification under Theodosius II and Justinian I. Although codes were replaced by custom and case law during the Dark Ages, Roman law was rediscovered around the 11th century when medieval legal scholars began to research Roman codes and adapt their concepts. Latin legal maxims were compiled for guidance. In medieval England, royal
