European Communities Act 1972 (UK)
The European Communities Act 1972 known as the ECA 1972 is an Act of the Parliament of the United Kingdom which made legal provision for the accession of the United Kingdom to the three European Communities, namely the EEC, the Coal and Steel Community. The Treaty of Accession was signed by the Conservative Prime Minister Edward Heath and the President of the European Commission Franco Maria Malfatti in Brussels on 22 January 1972; the Act provided for the incorporation into UK law of the whole of European Community law and its "acquis communautaire": its Treaties and Directives, together with judgments of the European Court of Justice. By the Act, Community Law became binding on all legislation passed by the UK Parliament. Arguably the most significant statute to be passed by the Heath government of 1970-74, the Act is one of the most significant UK constitutional statutes passed; the act has been amended from its original form, incorporating the changes wrought by the Single European Act, the Maastricht Treaty, the Amsterdam Treaty, the Nice Treaty, the Treaty of Lisbon.
On 13 July 2017, the Brexit Secretary, David Davis, introduced what became the European Union Act to Parliament which makes provision for repealing the 1972 Act on "exit day", when enacted defined as 29 March 2019 at 11 p.m. but postponed by EU decision to either 22 May 2019 or 12 April 2019. When the European Communities came into being in 1958, the UK chose to remain aloof and instead join the alternative bloc, EFTA; the British government regretted its decision, in 1961, along with Denmark and Norway, the UK applied to join the three Communities. However, President Charles de Gaulle saw British membership as a Trojan horse for US influence, vetoed it; the four countries resubmitted their applications in 1967, the French veto was lifted upon Georges Pompidou succeeding de Gaulle in 1969. In 1970, accession negotiations took place between the UK Government, led by Conservative Prime Minister Edward Heath, the European Communities and various European leaders. Despite disagreements over the CAP and the UK's relationship with the Commonwealth, terms were agreed.
In October 1971, after a lengthy Commons debate, MPs voted 356-244 in favour of joining the EEC. For the Treaty to take effect upon entry into the Communities on 1 January 1973, for the UK to embrace the EEC Institutions and Community law, an Act of Parliament was required. Only three days after the signing of the Treaty, a European Communities Bill of just 12 clauses was presented to the House of Commons by Geoffrey Rippon; the European Communities Act came into being, Edward Heath signed the Treaty of Accession in Brussels on 22 January 1972. Denmark and Ireland joined the Community on the same day, 1 January 1973, as the UK; the European Communities Bill was introduced the House of Commons for its first reading by Geoffrey Rippon, Chancellor of the Duchy of Lancaster on 26 January 1972. On 17 February 1972, the House of Commons voted narrowly by 309-301 in favour of the Bill at its second reading, after three days of intense debate. Just before the vote the Prime Minister Edward Heath argued his case in the debate with the following words.
The Bill passed on to Committee Stage before its third reading. During this discussion in the House of Commons, MPs pointed out that the Government had structured the European Communities Bill so that Parliament could debate the technical issues about how the treaty enactment would occur but could not debate the treaty of accession itself and decried this sacrifice of Parliament's sovereignty to the Government's desire to join the European project. On 13 July 1972, the House of Commons voted 301-284 in favour of the Bill in its third and final reading before passing on to the House of Lords. Before the vote took place, Geoffrey Rippon argued in the House of Commons before the vote: The Bill passed to the House of Lords; the Act received Royal Assent on 17 October, the UK's instrument of ratification of the Treaty of Accession was deposited the next day with the Italian government as required by the Treaty. Since the Treaty specified its effective date as 1 January 1973 and the Act specified only "entry date" for its actions, the Act and the Treaty took effect 1 January 1973, when the United Kingdom became a member state of the European Communities along with Denmark and the Republic of Ireland.
The European Communities Act was the instrument whereby the UK Parliament effected the changes required by the Treaty of Accession by which the UK joined the European Union. Section 2 says "the Treaties are without further enactment to be given legal effect" in the UK, it enables, under section 2, UK government ministers to make regulations to transpose EU Directives and rulings of the European Court of Justice into UK law. The Treaty itself says the member states will conform themselves to the European Communities existing and future decisions; the Act and the Treaty of Accession have been interpreted by UK courts
Erskine May: Parliamentary Practice
Erskine May is a parliamentary authority written by British constitutional theorist and Clerk of the House of Commons, Thomas Erskine May. Erskine May is considered to be the most authoritative and influential work on parliamentary procedure and the constitutional conventions affecting Parliament which form a major part of the uncodified UK constitution, it is not a rigid set of rules but a description of how the procedure evolved and of the conventions. Such is the authority of the text that it is regarded as analogous to part of the constitution itself. Since its first publication in 1844, the book has been updated. Erskine May edited nine editions of the book in his lifetime. Updates have continued into the present day; the Speaker's Commission on Digital Democracy recommended in 2015 that "Erskine May, the definitive guide to parliamentary procedure, should be available online by the time the next edition is produced."The work has been influential outside the United Kingdom in countries that use the Westminster system.

London is the capital and largest city of both England and the United Kingdom. Standing on the River Thames in the south-east of England, at the head of its 50-mile estuary leading to the North Sea, London has been a major settlement for two millennia. Londinium was founded by the Romans; the City of London, London's ancient core − an area of just 1.12 square miles and colloquially known as the Square Mile − retains boundaries that follow its medieval limits. The City of Westminster is an Inner London borough holding city status. Greater London is governed by the Mayor of the London Assembly. London is considered to be one of the world's most important global cities and has been termed the world's most powerful, most desirable, most influential, most visited, most expensive, sustainable, most investment friendly, most popular for work, the most vegetarian friendly city in the world. London exerts a considerable impact upon the arts, education, fashion, healthcare, professional services and development, tourism and transportation.
London ranks 26 out of 300 major cities for economic performance. It is one of the largest financial centres and has either the fifth or sixth largest metropolitan area GDP, it is the most-visited city as measured by international arrivals and has the busiest city airport system as measured by passenger traffic. It is the leading investment destination, hosting more international retailers and ultra high-net-worth individuals than any other city. London's universities form the largest concentration of higher education institutes in Europe. In 2012, London became the first city to have hosted three modern Summer Olympic Games. London has a diverse range of people and cultures, more than 300 languages are spoken in the region, its estimated mid-2016 municipal population was 8,787,892, the most populous of any city in the European Union and accounting for 13.4% of the UK population. London's urban area is the second most populous in the EU, after Paris, with 9,787,426 inhabitants at the 2011 census.
The population within the London commuter belt is the most populous in the EU with 14,040,163 inhabitants in 2016. London was the world's most populous city from c. 1831 to 1925. London contains four World Heritage Sites: the Tower of London. Other landmarks include Buckingham Palace, the London Eye, Piccadilly Circus, St Paul's Cathedral, Tower Bridge, Trafalgar Square and The Shard. London has numerous museums, galleries and sporting events; these include the British Museum, National Gallery, Natural History Museum, Tate Modern, British Library and West End theatres. The London Underground is the oldest underground railway network in the world. "London" is an ancient name, attested in the first century AD in the Latinised form Londinium. Over the years, the name has attracted many mythicising explanations; the earliest attested appears in Geoffrey of Monmouth's Historia Regum Britanniae, written around 1136. This had it that the name originated from a supposed King Lud, who had taken over the city and named it Kaerlud.
Modern scientific analyses of the name must account for the origins of the different forms found in early sources Latin, Old English, Welsh, with reference to the known developments over time of sounds in those different languages. It is agreed; this was adapted into Latin as Londinium and borrowed into Old English, the ancestor-language of English. The toponymy of the Common Brythonic form is much debated. A prominent explanation was Richard Coates's 1998 argument that the name derived from pre-Celtic Old European *lowonida, meaning "river too wide to ford". Coates suggested that this was a name given to the part of the River Thames which flows through London. However, most work has accepted a Celtic origin for the name, recent studies have favoured an explanation along the lines of a Celtic derivative of a proto-Indo-European root *lendh-, combined with the Celtic suffix *-injo- or *-onjo-. Peter Schrijver has suggested, on these grounds, that the name meant'place that floods'; until 1889, the name "London" applied to the City of London, but since it has referred to the County of London and Greater London.
"London" is sometimes written informally as "LDN". In 1993, the remains of a Bronze Age bridge were found on the south foreshore, upstream of Vauxhall Bridge; this bridge either reached a now lost island in it. Two of those timbers were radiocarbon dated to between 1750 BC and 1285 BC. In 2010 the foundations of a large timber structure, dated to between 4800 BC and 4500 BC, were found on the Thames's south foreshore, downstream of Vauxhall Bridge; the function of the mesolithic structure is not known. Both structures are on the south bank. Although there is evidence of scattered Brythonic settlements in the area, the first major settlement was founded by the Romans about four years after the invasion
Prime Minister of the United Kingdom
The Prime Minister of the United Kingdom is the head of government of the United Kingdom. The Prime Minister directs both the executive and the legislature, together with their Cabinet are collectively accountable for their policies and actions to the Monarch, to Parliament, to their political party and to the electorate; the office of Prime Minister is one of the Great Offices of State. The current holder of the office, Theresa May, leader of the Conservative Party, was appointed by the Queen on 13 July 2016; the office is not established by any statute or constitutional document but exists only by long-established convention, which stipulates that the monarch must appoint as Prime Minister the person most to command the confidence of the House of Commons. The position of Prime Minister was not created; the office is therefore best understood from a historical perspective. The origins of the position are found in constitutional changes that occurred during the Revolutionary Settlement and the resulting shift of political power from the Sovereign to Parliament.
Although the Sovereign was not stripped of the ancient prerogative powers and remained the head of government, politically it became necessary for him or her to govern through a Prime Minister who could command a majority in Parliament. By the 1830s the Westminster system of government had emerged; the political position of Prime Minister was enhanced by the development of modern political parties, the introduction of mass communication, photography. By the start of the 20th century the modern premiership had emerged. Prior to 1902, the Prime Minister sometimes came from the House of Lords, provided that his government could form a majority in the Commons; however as the power of the aristocracy waned during the 19th century the convention developed that the Prime Minister should always sit in the lower house. As leader of the House of Commons, the Prime Minister's authority was further enhanced by the Parliament Act 1911 which marginalised the influence of the House of Lords in the law-making process.
The Prime Minister is ex officio First Lord of the Treasury and Minister for the Civil Service. Certain privileges, such as residency of 10 Downing Street, are accorded to Prime Ministers by virtue of their position as First Lord of the Treasury; the status of the position as Prime Minister means that the incumbent is ranked as one of the most powerful and influential people in the world. The Prime Minister is the head of the United Kingdom government; as such, the modern Prime Minister leads the Cabinet. In addition, the Prime Minister leads a major political party and commands a majority in the House of Commons; the incumbent wields both significant legislative and executive powers. Under the British system, there is a unity of powers rather than separation. In the House of Commons, the Prime Minister guides the law-making process with the goal of enacting the legislative agenda of their political party. In an executive capacity, the Prime Minister appoints all other Cabinet members and ministers, co-ordinates the policies and activities of all government departments, the staff of the Civil Service.
The Prime Minister acts as the public "face" and "voice" of Her Majesty's Government, both at home and abroad. Upon the advice of the Prime Minister, the Sovereign exercises many statutory and prerogative powers, including high judicial, political and Church of England ecclesiastical appointments; the British system of government is based on an uncodified constitution, meaning that it is not set out in any single document. The British constitution consists of many documents and most for the evolution of the Office of the Prime Minister, it is based on customs known as constitutional conventions that became accepted practice. In 1928, Prime Minister H. H. Asquith described this characteristic of the British constitution in his memoirs:In this country we live... under an unwritten Constitution. It is true that we have on the Statute-book great instruments like Magna Carta, the Petition of Right, the Bill of Rights which define and secure many of our rights and privileges, they rest on usage, convention of slow growth in their early stages, not always uniform, but which in the course of time received universal observance and respect.
The relationships between the Prime Minister and the Sovereign and Cabinet are defined by these unwritten conventions of the constitution. Many of the Prime Minister's executive and legislative powers are royal prerogatives which are still formally vested in the Sovereign, who remains the head of state. Despite its growing
John Simon Bercow is a British politician, the Speaker of the House of Commons since June 2009. He concurrently serves as the Member of Parliament for Buckingham. Prior to his election to Speaker, he was a member of the Conservative Party. A former right-winger, he changed his views after becoming an MP and at one time was rumoured to be to defect to the Labour Party. Bercow's election to the Speaker's chair depended on the backing of other parties, was unpopular with many of his former Conservative Party colleagues, he served as a councillor from 1986 to 1990 and unsuccessfully contested parliamentary seats in the 1987 and 1992 general elections. In the 1997 general election, Bercow was elected the MP for Buckingham and promoted to the shadow cabinet in 2001, he held posts in the shadow cabinets of Iain Duncan Michael Howard. In November 2002, he resigned from the shadow cabinet over disputes concerning the Adoption and Children Act but returned under Howard in 2003. In September 2004, Bercow was dismissed after disagreements with Howard.
Following the resignation of Speaker Michael Martin, Bercow announced his intention to stand for the Speakership election on 22 June 2009 and was successful. He remained Speaker and was re-elected in his constituency at the general election on 7 May 2015, he was re-elected as Speaker, when the House sat at the start of the new parliament on 18 May 2015. Following the 2017 general election, Bercow was re-elected, again unopposed, as Speaker, on 13 June 2017, he is the first Speaker since the Second World War to be elected to the post three times. In October 2009, Bercow chaired the United Kingdom Youth Parliament's first annual sitting in the House of Commons, making them the only group except Members of Parliament to sit in the chamber, he has chaired every subsequent sitting and attended every annual conference and supporting Members of Youth Parliament from across the UK. In 2014, Bercow was appointed Chancellor of the University of Bedfordshire, in July 2017 he was appointed Chancellor of the University of Essex.
In October 2018, it was reported that Bercow intended to step down as Speaker in the summer of 2019, due to a report on the failure of high-level figures in Parliament to deal adequately with bullying of staff at Westminster and due to allegations of bullying made against him personally. However, it was reported that Bercow planned "to stay as speaker" until the end of parliament in 2022. Bercow was born in Edgware, the son of Brenda and Charles Bercow, a taxi driver, his father was born to his mother converted to Judaism. His paternal grandparents were Jews. Having settled in the UK, the family anglicised its surname from Berkowitz to Bercow. Bercow attended Frith Manor Primary School in Woodside Park, Finchley Manorhill, a large comprehensive school in North Finchley. In his youth, Bercow had been ranked Britain's No. 1 junior tennis player, but came down with bronchial asthma and was unable to pursue a professional career. Bercow graduated with a first-class honours degree in government from the University of Essex in 1985.
Professor Anthony King said "When he was a student here, he was right-wing, pretty stroppy, good. He was an outstanding student."As a young activist, Bercow was a member of the right-wing Conservative Monday Club. He stood as a candidate for the club's national executive in 1981 with a manifesto calling for a programme of "assisted repatriation" of immigrants, became secretary of its immigration and repatriation committee. However, at the age of 20 he left the club, citing the views of many of the club's members as his reason, has since called his participation in the club "utter madness" and dismissed his views from that period as "bone headed". After graduating from the University of Essex, Bercow was elected as the last national chairman of the Federation of Conservative Students, 1986–87; the FCS was broken up by the chairman of the Conservative Party, Norman Tebbit, after one of its members had accused previous Tory PM Harold Macmillan of war crimes in extraditing Cossacks to the Soviet Union.
Bercow attracted the attention of the Conservative leadership, in 1987 he was appointed by Tebbit as vice-chairman of the Conservative Collegiate Forum to head the campaign for student support in the run-up to the 1987 general election. After a spell in merchant banking, Bercow joined the lobbying firm Rowland Sallingbury Casey in 1988, becoming a board director within five years. With fellow Conservative Julian Lewis, Bercow ran an advanced speaking and campaigning course for over 10 years, which trained over 600 Conservatives in campaigning and communication techniques, he has lectured in the United States to students of the Leadership Institute. In 1986, Bercow was elected as a Conservative councillor in the London Borough of Lambeth, served for four years representing the Streatham, St Leonard's ward. In 1987, he was appointed the youngest deputy group leader in the United Kingdom. In 1995, Bercow was appointed as a special adviser to the Chief Secretary to the Treasury, Jonathan Aitken.
After Aitken's resignation to fight a libel action, Bercow served as a special adviser to the Secretary of State for National Heritage, Virginia Bottomley. Bercow was an unsuccessful Conservative candidate in the 1987 general election in Motherwell South, again at the 1992 general election in Bristol South. In 1996 he paid £1,000 to charter a helicopter so that he could attend the selection meetings for two safe Conservative parliamentary seats on the same day – Buckingham and Surrey Heath –
Philip Anthony Hammond is a British Conservative politician serving as Chancellor of the Exchequer since 2016 and the Member of Parliament for Runnymede and Weybridge since 1997. Hammond was born in Epping and studied Philosophy and Economics at University College, Oxford, he worked from 1984 as a company director at Castlemead Ltd -- a nursing company. From 1995-97 he acted as an adviser to the government of Malawi before his election to Parliament, he was promoted to the Shadow Cabinet by David Cameron in 2005 as Shadow Secretary of State for Work and Pensions, remaining in this position until a 2007 reshuffle when he became Shadow Chief Secretary to the Treasury. After the formation of the Coalition Government in May 2010, he was appointed Secretary of State for Transport and was sworn of the Privy Council. Upon the resignation of Liam Fox over a scandal in October 2011, Hammond was promoted to replace him as Secretary of State for Defence, before being further promoted in July 2014 to become Secretary of State for Foreign and Commonwealth Affairs.
In July 2016, after Theresa May succeeded Cameron as Prime Minister, Hammond was appointed Chancellor of the Exchequer. As Chancellor, Hammond has suggested that the government may begin a reduction in austerity measures. Hammond was born in Epping, the son of a civil engineer, he was educated at Shenfield School in Essex where he was a classmate of Richard Madeley. He read Philosophy and Economics at University College, where he was an Open Scholar, graduated with a first-class honours degree. Hammond joined the medical equipment manufacturers Speywood Laboratories Ltd in 1977, becoming a director of Speywood Medical Limited in 1981, he left in 1983 and, from 1984, served as a director in Castlemead Ltd. From 1993 to 1995, he was a partner in CMA Consultants and, from 1994, a director in Castlemead Homes, he had many business interests including house building and property, manufacturing and oil and gas. He undertook various consulting assignments in Latin America for the World Bank in Washington, D.
C. and was a consultant to the Government of Malawi from 1995 until his election to Parliament. Hammond was the Chairman of the Lewisham East Conservative Association for seven years from 1989 and contested the 1994 Newham North East by-election following the death of sitting Labour MP Ron Leighton, losing to Labour's Stephen Timms by 11,818 votes, he was elected to the House of Commons at the 1997 general election for the newly created Surrey seat of Runnymede and Weybridge. He has remained its MP since, he made his maiden speech on 17 June 1997. In Parliament he served on the Environment and the Regions Select Committee from 1997 until he was promoted by William Hague as front bench spokesman for Health, he was moved to become spokesman for Trade and Industry by Iain Duncan Smith in 2001, transferred to Shadow Minister for Local Government and Regions in 2002. Howard promoted Hammond to his Shadow Cabinet following the 2005 general election as Shadow Chief Secretary to the Treasury. Following the election of David Cameron as Conservative leader in 2005, Hammond became the Shadow Secretary of State for Work and Pensions.
He was moved back to the role of Shadow Chief Secretary to the Treasury in David Cameron's reshuffle following Gordon Brown's accession to the premiership. Hammond was appointed Secretary of State for Transport following the formation of the coalition government on 12 May 2010, a position he held until 14 October 2011. On 28 September 2011, he announced that the government was to initiate a consultation on plans to raise the speed limit on motorways from 70 mph to 80 mph, with a view to introducing the new limit in 2013. However, following criticism, including that modelling predicted a 20+% increase in motorway deaths and would alienate women voters, the plans were dropped by his successor. Hammond became Secretary of State for Defence on 14 October 2011; as Secretary of State for Defence, Hammond became a member of the National Security Council. In December 2011, he announced; the first women officers began serving on Vanguard class submarines in late 2013. They were due to be followed by female ratings in 2015, when women should begin serving on the new Astute class submarine.
It was confirmed that the cost of the Libyan operations was £212 million – less than was estimated – including £67 million for replacing spent munitions, is all expected to be met from HM Treasury's reserve. In January 2012, the Ministry of Defence announced 4,200 job cuts in a second round of armed forces redundancies; the Army would see up to 2,900 job cuts, including 400 Gurkhas, while the RAF would lose up to 1,000 members and the Royal Navy up to 300. The job losses would account for some of the cuts announced under the defence review – intended to help plug the £38 billion hole in the defence budget. Hammond said the Government had "no choice but to reduce the size of the armed forces – while reconfiguring them to ensure they remain agile and effective"; the £38 billion "black hole" in MoD finances had been "dealt with" and the department's "hand to mouth existence would come to an end", Hammond stated in February 2012. Ministers had found £2.1 billion to be allocated to several major spending projects to be announced in the coming weeks.

The government of the United Kingdom exercises its executive authority through a number of government departments or departments of state. A department is composed of employed officials, known as civil servants, is politically accountable through a minister. Most major departments are headed by a secretary of state, who sits in the cabinet, supported by a team of junior ministers. There are a number of non-ministerial departments; these are headed by senior civil servants, but are linked to a ministerial department through whose ministers they are accountable to Parliament. Departments serve to implement the policies of Her Majesty's Government, regardless of the government's political composition; as a consequence, officials within government departments are required to adhere to varying levels of political impartiality and neutrality. There are two types of government departments. Ministerial departments are led politically by a government minister a member of the cabinet and cover matters that require direct political oversight.
For most departments, the government minister in question is known as a secretary of state. He or she is supported by a team of junior ministers; the administrative management of a department is led by a senior civil servant, known as a permanent secretary. Subordinate to these ministerial departments are executive agencies. An executive agency has a degree of autonomy to perform an operational function and report to one or more specific government departments, which will set the funding and strategic policy for the agency. At "arm's length" from a parent or sponsor department there can be a number of non-departmental public bodies, known colloquially as quasi-autonomous non-governmental organisations. Non-ministerial departments cover matters for which direct political oversight is judged unnecessary or inappropriate, they are headed by senior civil servants. Some fulfil a regulatory or inspection function, their status is therefore intended to protect them from political interference; some are headed by Second Permanent Secretaries.
