English law is the common law legal system of England and Wales, comprising criminal law and civil law, each branch having its own courts and procedures. England's most authoritative law is statutory legislation, which comprises Acts of Parliament, regulations and by-laws. In the absence of any statutory law, the common law with its principle of stare decisis forms the residual source of law, based on judicial decisions and usage. Common law is made by sitting judges who apply both statutory law and established principles which are derived from the reasoning from earlier decisions. Equity is the other historic source of judge-made law. Common law can be repealed by Parliament. Not being a civil law system, English law has no comprehensive codification. However, most of its criminal law has been codified from its common law origins, in the interests both of certainty and of ease of prosecution. For the time being, murder remains a common law crime rather than a statutory offence. Although Scotland and Northern Ireland form part of the United Kingdom and share Westminster as a primary legislature, they have separate legal systems outside of English Law.
International treaties such as the European Union's Treaty of Rome or the Hague-Visby Rules have effect in English law only when adopted and ratified by Act of Parliament. Adopted treaties may be subsequently denounced by executive action.. Unless the denouncement or withdraw would affect rights enacted by parliament. In this case executive action cannot be used due to the doctrine of Parliamentary sovereignty; this principle was established in the case of Miller v Secretary of State for Exiting the European Union in 2017. Criminal law is the law of punishment whereby the Crown prosecutes the accused. Civil law is concerned with tort, families, companies and so on. Civil law courts operate to provide a party who has an enforceable claim with a remedy such as damages or a declaration. In this context, civil law is the system of codified law, prevalent in Europe. Civil law is founded on the ideas of Roman Law. By contrast, English law is the archetypal common law jurisdiction, built upon case law.
In this context, common law means the judge-made law of the King's Bench. Equity is concerned with trusts and equitable remedies. Equity operates in accordance with the principles known as the "maxims of equity"; the reforming Judicature Acts of the 1880s amalgamated the courts into one Supreme Court of Judicature, directed to administer both law and equity. The neo-gothic Royal Courts of Justice in The Strand, were built shortly afterwards to celebrate these reforms. Public Law is the law governing relationships between the state. Private law encompasses relationships between other private entities. A remedy is "the means given by law for the recovery of a right, or of compensation for its infringement". Most remedies are available only from the court. Most civil actions claiming damages in the High Court were commenced by obtaining a writ issued in the Queen's name. After 1979, writs have required the parties to appear, writs are no longer issued in the name of the Crown. Now, after the Woolf Reforms of 1999 all civil actions other than those connected with insolvency, are commenced by the completion of a Claim Form as opposed to a Writ, Originating Application, or Summons.

For example, the Pleading in English Act 1362 was referred to as 36 Edw. III c. 15, meaning "36th year of the reign of Edward III, chapter 15".. Common law is a term with historical origins in the legal system of England, it denotes, in the first place, the judge-made law that developed from the early Middle Ages as described in a work published at the end of the 19th century, The History of English Law before the Time of Edward I, in which Pollock and Maitland expanded the work of Coke and Blackstone.
The law developed in England's Court of Common Pleas and other common law courts, which became the law of the colonies settled under the crown of England or of the United Kingdom, in North America and elsewhere.
2 Marsham Street
2 Marsham Street is an office building on Marsham Street in the City of Westminster and has been the headquarters of the Home Office, a department of the British Government, since March 2005. Before this date the Home Office was located at 50 Queen Anne's Gate, it has housed the headquarters of the Department for Environment and Rural Affairs since 2018. The site was occupied by the Departments of Environment and Transport; the headquarters offices of both departments were located in Marsham Towers - three 20-floor concrete towers joined together by'podium' floors to level 3. The towers won an architectural award and boasted express lifts, marble entrances and escalators to the 3rd floor - modern government offices for the early 1970s. Construction had started in the early 1960s but was completed in 1971 and became the office of the new Department of Environment created in October 1970; the towers were considered by some to be a blot on London’s landscape and were subsequently nicknamed "the three ugly sisters" and "the toast rack".
Michael Heseltine, the Secretary of State for the Environment in the late 1970s and early 1980s said that the building offered the best view of London – because one could not see the towers from his north-facing 16th floor North tower office. Chris Patten called the complex "a building that depresses the spirit"; the last government staff occupied the building in the late 1990s. The building was declared unfit for future use and the towers were demolished in 2003 to make way for the new building into which the Home Office moved in 2005. Prior to the'ugly sisters' epoch, from about 1818, the site housed the Chartered Gas Works of the Westminster Gas Light and Coke Company, as well as a laundry yard. Soon after the building opened in 2005, agencies of the Home Office like Her Majesty's Passport Office and the Advisory Council on the Misuse of Drugs began moving to new offices. Since August 2014 to autumn 2018, building has been home to the Department for Communities and Local Government, the Homes and Communities Agency and the Building Regulations Advisory Committee.
In 2018, the Department for Environment and Rural Affairs relocated to 2 Marsham Street. In 2018, the Homes England moved to Windsor House. Designed by Terry Farrell, the new building was financed through the private finance initiative model with French construction firm Bouygues as contractor, it was completed within 24 months. The cost of £311 million will be spread over 29 years and will be met by the issue of bonds; the site is made up of three buildings, designated Seacole and Fry. They are named after Mary Seacole, Robert Peel and Elizabeth Fry, figures who had significant impacts in areas within the Home Office's responsibility; the buildings are connected by a bridge from the 1st to the 4th floors, forming part of a corridor that runs the whole length of the building. Staff call this corridor'The Street'. During design, the emphasis was on creating a building with a community feel. To that end, the open-plan offices are well lit, situated around three central atria and overlooking turfed'pocket parks'.
The building has been constructed to be energy efficient and to fall well within government energy-expenditure targets. The approachable effect of the building is enhanced by art-work by Liam Gillick who used coloured glass to change the feel of the building depending on the light conditions; the site contains 800,000 sq ft of office space. Part of the old Marsham Towers site was turned over to blocks of residential flats and restaurants behind the new Home Office building. Since its completion in early 2005, 2 Marsham Street has been well received by the architectural community, winning a RIBA Award for Architecture, a Leading European Architects Forum and MIPIM 2006 Awards. Giles Worsley, architecture critic of The Daily Telegraph, called the building "a triumph of urban repair"; the contractor's provision of the building within the time-frame required has been praised. The Home Secretary at the time of the building's completion, Charles Clarke, has stated "By moving to a newer, more efficient headquarters, the Home Office will save taxpayers around £95m.

House of Lords
The House of Lords known as the House of Peers, is the upper house of the Parliament of the United Kingdom. Membership is else by heredity or official function. Like the House of Commons, it meets in the Palace of Westminster; the full name of the house is the Right Honourable the Lords Spiritual and Temporal of the United Kingdom of Great Britain and Northern Ireland in Parliament assembled. Unlike the elected House of Commons, members of the House of Lords are appointed; the membership of the House of Lords is drawn from the peerage and is made up of Lords Spiritual and Lords Temporal. The Lords Spiritual are 26 bishops in the established Church of England. Of the Lords Temporal, the majority are life peers who are appointed by the monarch on the advice of the Prime Minister, or on the advice of the House of Lords Appointments Commission. However, they include some hereditary peers including four dukes. Membership was once an entitlement of all hereditary peers, other than those in the peerage of Ireland, but under the House of Lords Act 1999, the right to membership was restricted to 92 hereditary peers.
Since 2008, only one of them is female. While the House of Commons has a defined number of seats membership, the number of members in the House of Lords is not fixed; the House of Lords is the only upper house of any bicameral parliament in the world to be larger than its lower house. The House of Lords scrutinises bills, it reviews and amends Bills from the Commons. While it is unable to prevent Bills passing into law, except in certain limited circumstances, it can delay Bills and force the Commons to reconsider their decisions. In this capacity, the House of Lords acts as a check on the House of Commons, independent from the electoral process. Bills can be introduced into the House of Commons. While members of the Lords may take on roles as government ministers, high-ranking officials such as cabinet ministers are drawn from the Commons; the House of Lords has its own support services, separate from the Commons, including the House of Lords Library. The Queen's Speech is delivered in the House of Lords during the State Opening of Parliament.
In addition to its role as the upper house, until the establishment of the Supreme Court in 2009, the House of Lords, through the Law Lords, acted as the final court of appeal in the United Kingdom judicial system. The House has a Church of England role, in that Church Measures must be tabled within the House by the Lords Spiritual. Today's Parliament of the United Kingdom descends, in practice, from the Parliament of England, though the Treaty of Union of 1706 and the Acts of Union that ratified the Treaty in 1707 and created a new Parliament of Great Britain to replace the Parliament of England and the Parliament of Scotland; this new parliament was, in effect, the continuation of the Parliament of England with the addition of 45 MPs and 16 Peers to represent Scotland. The House of Lords developed from the "Great Council"; this royal council came to be composed of ecclesiastics and representatives of the counties of England and Wales. The first English Parliament is considered to be the "Model Parliament", which included archbishops, abbots, earls and representatives of the shires and boroughs of it.
The power of Parliament grew fluctuating as the strength of the monarchy grew or declined. For example, during much of the reign of Edward II, the nobility was supreme, the Crown weak, the shire and borough representatives powerless. In 1569, the authority of Parliament was for the first time recognised not by custom or royal charter, but by an authoritative statute, passed by Parliament itself. During the reign of Edward II's successor, Edward III, Parliament separated into two distinct chambers: the House of Commons and the House of Lords; the authority of Parliament continued to grow, during the early 15th century both Houses exercised powers to an extent not seen before. The Lords were far more powerful than the Commons because of the great influence of the great landowners and the prelates of the realm; the power of the nobility declined during the civil wars of the late 15th century, known as the Wars of the Roses. Much of the nobility was killed on the battlefield or executed for participation in the war, many aristocratic estates were lost to the Crown.
Moreover, feudalism was dying, the feudal armies controlled by the barons became obsolete. Henry VII established the supremacy of the monarch, symbolised by the "Crown Imperial"; the domination of the Sovereign continued to grow during the reigns of the Tudor monarchs in the 16th century. The Crown was at the height of its power during the reign of Henry VIII; the House of Lords remained more powerful than the House of Commons, but the Lower House continued to grow in influence, reaching a zenith in relation to the House of Lords during the middle 17th century. Prime Minister of the United Kingdom
The Prime Minister of the United Kingdom is the head of government of the United Kingdom. The Prime Minister directs both the executive and the legislature, together with their Cabinet are collectively accountable for their policies and actions to the Monarch, to Parliament, to their political party and to the electorate; the office of Prime Minister is one of the Great Offices of State. The current holder of the office, Theresa May, leader of the Conservative Party, was appointed by the Queen on 13 July 2016; the office is not established by any statute or constitutional document but exists only by long-established convention, which stipulates that the monarch must appoint as Prime Minister the person most to command the confidence of the House of Commons. The position of Prime Minister was not created; the office is therefore best understood from a historical perspective. The origins of the position are found in constitutional changes that occurred during the Revolutionary Settlement and the resulting shift of political power from the Sovereign to Parliament.
Although the Sovereign was not stripped of the ancient prerogative powers and remained the head of government, politically it became necessary for him or her to govern through a Prime Minister who could command a majority in Parliament. By the 1830s the Westminster system of government had emerged; the political position of Prime Minister was enhanced by the development of modern political parties, the introduction of mass communication, photography. By the start of the 20th century the modern premiership had emerged. Prior to 1902, the Prime Minister sometimes came from the House of Lords, provided that his government could form a majority in the Commons; however as the power of the aristocracy waned during the 19th century the convention developed that the Prime Minister should always sit in the lower house. As leader of the House of Commons, the Prime Minister's authority was further enhanced by the Parliament Act 1911 which marginalised the influence of the House of Lords in the law-making process.
The Prime Minister is ex officio First Lord of the Treasury and Minister for the Civil Service. Certain privileges, such as residency of 10 Downing Street, are accorded to Prime Ministers by virtue of their position as First Lord of the Treasury; the status of the position as Prime Minister means that the incumbent is ranked as one of the most powerful and influential people in the world. The Prime Minister is the head of the United Kingdom government; as such, the modern Prime Minister leads the Cabinet. In addition, the Prime Minister leads a major political party and commands a majority in the House of Commons; the incumbent wields both significant legislative and executive powers. Under the British system, there is a unity of powers rather than separation. In the House of Commons, the Prime Minister guides the law-making process with the goal of enacting the legislative agenda of their political party. In an executive capacity, the Prime Minister appoints all other Cabinet members and ministers, co-ordinates the policies and activities of all government departments, the staff of the Civil Service.
The Prime Minister acts as the public "face" and "voice" of Her Majesty's Government, both at home and abroad. Upon the advice of the Prime Minister, the Sovereign exercises many statutory and prerogative powers, including high judicial, political and Church of England ecclesiastical appointments; the British system of government is based on an uncodified constitution, meaning that it is not set out in any single document. The British constitution consists of many documents and most for the evolution of the Office of the Prime Minister, it is based on customs known as constitutional conventions that became accepted practice. In 1928, Prime Minister H. H. Asquith described this characteristic of the British constitution in his memoirs:In this country we live... under an unwritten Constitution. It is true that we have on the Statute-book great instruments like Magna Carta, the Petition of Right, the Bill of Rights which define and secure many of our rights and privileges, they rest on usage, convention of slow growth in their early stages, not always uniform, but which in the course of time received universal observance and respect.
The relationships between the Prime Minister and the Sovereign and Cabinet are defined by these unwritten conventions of the constitution. Many of the Prime Minister's executive and legislative powers are royal prerogatives which are still formally vested in the Sovereign, who remains the head of state. Despite its growing
House of Commons of the United Kingdom
The House of Commons is the lower house of the Parliament of the United Kingdom. Like the upper house, the House of Lords, it meets in the Palace of Westminster; the full name of the house is the Honourable the Commons of the United Kingdom of Great Britain and Northern Ireland in Parliament assembled. Owing to shortage of space, its office accommodation extends into Portcullis House; the Commons is an elected body consisting of 650 members known as Members of Parliament. Members are elected to represent constituencies by the first-past-the-post system and hold their seats until Parliament is dissolved; the House of Commons of England started to evolve in 14th centuries. It became the House of Commons of Great Britain after the political union with Scotland in 1707, assumed the title of "House of Commons of Great Britain and Ireland" after the political union with Ireland at the start of the 19th century; the "United Kingdom" referred to was the United Kingdom of Great Britain and Ireland from 1800, became the United Kingdom of Great Britain and Northern Ireland after the independence of the Irish Free State in 1922.
Accordingly, the House of Commons assumed its current title. Under the Parliament Act 1911, the Lords' power to reject legislation was reduced to a delaying power; the Government is responsible to the House of Commons and the Prime Minister stays in office only as long as she or he retains the confidence of a majority of the Commons. Although it does not formally elect the prime minister, the position of the parties in the House of Commons is of overriding importance. By convention, the prime minister is answerable to, must maintain the support of, the House of Commons. Thus, whenever the office of prime minister falls vacant, the Sovereign appoints the person who has the support of the House, or, most to command the support of the House—normally the leader of the largest party in the Commons, while the leader of the second-largest party becomes the Leader of the Opposition. Since 1963, by convention, the prime minister is always a member of the House of Commons, rather than the House of Lords.
The Commons may indicate its lack of support for the Government by rejecting a motion of confidence or by passing a motion of no confidence. Confidence and no confidence motions are phrased explicitly, for instance: "That this House has no confidence in Her Majesty's Government." Many other motions were until recent decades considered confidence issues though not explicitly phrased as such: in particular, important bills that were part of the Government's agenda. The annual Budget is still considered a matter of confidence; when a Government has lost the confidence of the House of Commons, the prime minister is obliged either to resign, making way for another MP who can command confidence, or to request the monarch to dissolve Parliament, thereby precipitating a general election. Parliament sits for a maximum term of five years. Subject to that limit, the prime minister could choose the timing of the dissolution of parliament, with the permission of the Monarch. However, since the Fixed-Term Parliaments Act 2011, terms are now a fixed five years, an early general election is brought about by a two-thirds majority in favour of a motion for a dissolution, or by a vote of no confidence, not followed within fourteen days by a vote of confidence.
By this second mechanism, the UK's government can change its political composition without an intervening general election. Only four of the eight last Prime Ministers have attained office as the immediate result of a general election; the latter four were Jim Callaghan, John Major, Gordon Brown and the current Prime Minister Theresa May. In such circumstances there may not have been an internal party leadership election, as the new leader may be chosen by acclaim, having no electoral rival. A prime minister will resign after party defeat at an election if unable to lead a coalition, or obtain a confidence and supply arrangement, she or he may resign after a motion of no confidence or for health reasons. In such cases, the premiership goes to, it has become the practice to write the constitution of major UK political parties to provide a set way in which to appoint a new leader. Until 1965, the Conservative Party had no fixed mechanism for this, it fell to the Queen to appoint Harold Macmillan as the new prime minister, after taking the consensus of cabinet ministers.
By convention, ministers are members of the House of House of Lords. A handful have been appointed who were outside Parliament, but in most cases they entered Parliament in a by-election or by receiving a peerage. Exceptions include Peter Mandelson, appointed Secretary of State for Business and Regulatory Reform in October 2008 before his peerage. Since 1902, all prime ministers have been members of the Commons; the new session of Parliament was delayed to await the outcome of his by-election, which happened
Constitution of the United Kingdom
The United Kingdom does not have a codified constitution such as other countries tend to have. Instead of such a constitution, certain documents stand to serve as replacements in lieu of one; these texts and their provisions therein are considered to be constitutional, such that the "constitution of the United Kingdom" or "British constitution" may refer to a number of historical and momentous laws and principles like the Acts of Union 1707 and the Acts of Union 1800 which formulate the country's body politic. Thus the term "UK constitution" is sometimes said to refer to an "unwritten" or uncodified constitution; the British constitution draws from four sources: statute law, common law, parliamentary conventions, works of authority. Similar to a constitutional document, it concerns both the relationship between the individual and the state and the functioning of the legislature, the executive, the judiciary. Since the Glorious Revolution of 1688, the concept of parliamentary sovereignty has been the bedrock of the British legislative constitution.
The statutes passed by Parliament are the supreme and final source of law in the UK. It follows that Parliament can change the constitution by passing new statutes through Acts of Parliament. There has been some debate about whether parliamentary sovereignty remained intact in the light of the UK's membership in the European Union, an argument, used by proponents of leaving the EU in the 2016 referendum. Another core constitutional principle, the rule of law, is a phrase, popularized by legal scholar Albert Dicey in his 1885 work Introduction to the Study of the Law of the Constitution, recognized by the British Parliament as a work of authority on the constitution. Acts of Parliament are bills which have received the approval of Parliament – that is, the Monarch, the House of Lords and the House of Commons. On rare occasions, the House of Commons uses the "Parliament Acts" to pass legislation without needing the approval of the House of Lords, it is unheard of in modern times for the Monarch to refuse to assent to a bill, though the possibility was contemplated by George V in relation to the fiercely controversial Government of Ireland Act 1914.
Acts of Parliament are among the most important sources of the constitution. According to the traditional view, Parliament has the power to legislate however it wishes on any subject it wishes. For example, most of the iconic medieval statute known as Magna Carta has been repealed since 1828, despite being regarded as sacrosanct, it has traditionally been the case that the courts are barred from questioning any Act of Parliament, a principle that can be traced back to the medieval period. On the other hand, this principle has not been without its dissidents and critics over the centuries, attitudes among the judiciary in this area may be changing. One consequence of the principle of parliamentary sovereignty is that there is no hierarchy among Acts of Parliament: all parliamentary legislation is, in principle, of equal validity and effectiveness. However, the judgment of Lord Justice Laws in the Thoburn case in 2002 indicated that there may be a special class of "constitutional statutes" such as Magna Carta, the Human Rights Act 1998, the European Communities Act 1972, the Acts of Union and Bill of Rights which have a higher status than other legislation.
This part of his judgment was "obiter" – and, was controversial. It remains to be seen. Treaties do not, on ratification, automatically become incorporated into UK law. Important treaties have been incorporated into domestic law by means of Acts of Parliament; the European Convention on Human Rights, for example, was given "further effect" into domestic law through the preamble of the Human Rights Act 1998. The Treaty of Union of 1707 was important in creating the unitary state which exists today; the treaty was between the governments of England and Scotland and was put into effect by two Acts of Union which were passed by the Parliaments of both nations. The Treaty, along with the subsequent Acts, brought into existence the Kingdom of Great Britain, uniting the Kingdom of England and the Kingdom of Scotland. Common law legal systems exist in Northern Ireland and in England and Wales, but not in Scotland which has a hybrid system which includes a great deal of Common Law. Court judgments commonly form a source of the constitution: speaking in English Law, judgments of the higher courts form precedents or case law that binds lower courts and judges.
However Scots Law does not accord the same status to precedent, judgments in one legal system do not have a direct effect in the other legal systems. Important court judgments include those in the Case of Proclamations, the Ship money case and Entick v Carrington, all of which imposed limits on the power of the executive. A constitutional precedent applicable to British colonies is Campbell v Hall, which extended those same constitutional limitations to any territory, granted a representative assembly. Many British constitutional conventions are ancient in origin, though others date from within living memory; such conventions, which include the duty of the Monarch to act on the advice of his or her ministers, are not formally enforceable in a court of law. The Crown is the state in all its aspects within the jurisprudence of the Commonwealth realms and their sub-divisions. Ill-defined, the term has different meanings depending on context, it is used to designate the monarch in either a personal capacity, as Head of the Commonwealth, or as the king or queen of his or her realms. It can refer to the rule of law. A corporation sole, the Crown is the legal embodiment of executive and judicial governance in the monarchy of each country; these monarchies are united by the personal union of their monarch. The concept of the Crown developed first in England as a separation of the literal crown and property of the kingdom from the person and personal property of the monarch, it spread through English and British colonisation and is now rooted in the legal lexicon of the United Kingdom, its Crown dependencies, the other 15 independent realms. It is not to be confused with any physical crown, such as those of the British regalia; the term is found in various expressions such as "Crown land", which some countries refer to as "public land" or "state land".
The concept of the Crown took form under the feudal system. Though not used this way in all countries that had this system, in England, all rights and privileges were bestowed by the ruler. Land, for instance, was granted by the Crown to lords in exchange for feudal services and they, in turn, granted the land to lesser lords. One exception to this was common socage—owners of land held as socage held it subject only to the Crown; when such lands become owner-less they are said to escheat. Bona vacantia is the royal prerogative; the monarch is the living embodiment of the Crown and, as such, is regarded as the personification of the state. The body of the reigning sovereign thus holds two distinct personas in constant coexistence: that of a natural-born human being and that of the state as accorded to him or her through law; the terms the state, the Crown, the Crown in Right of, Her Majesty the Queen in Right of, similar are all synonymous and the monarch's legal personality is sometimes referred to as the relevant jurisdiction's name.
As such, the king or queen is the employer of all government officials and staff, the guardian of foster children, as well as the owner of all state lands and equipment, state owned companies, the copyright for government publications. This is all in his or her position as sovereign, not as an individual; the Crown represents the legal embodiment of executive and judicial governance. While the Crown's legal personality is regarded as a corporation sole, it can, at least for some purposes, be described as a corporation aggregate headed by the monarch. Whilst the Crown refers to the monarch, this reference is made in re the monarch this reference is to the monarch in their capacity as monarch, does not refer to that individual in their totality of ownership interests and actions; the monarch can act in a private capacity. This duality of characterisation can be illustrated in several ways. In property ownership for example, although both are royal residences, Buckingham Palace is the property of the Crown via the Crown Estate whilst Balmoral Castle is the property of Elizabeth II and not of the Crown.
The latter property can be alienated by the Queen, whereas any disposition of the former property would need to be done via instrument of government as an act of state.
